Esta pesquisa tem como objetivo analisar a Lei nº 13.445, de 24 de maio de 2017 regulamentada pelo Decreto nº 9.199, de 20 de novembro de 2017 que revogou expressamente a Lei nº 6.815, de 19 de agosto de 1980 (Estatuto do Estrangeiro) que possui um viés de efetividade os direitos humanos em relação aos migrantes e refugiados dentro de um contexto de fluxo migratório crescente bem como propugna pela integração à sociedade brasileira como sujeitos de direitos e deveres. A pesquisa é de natureza teórico-bibliográfica seguindo o método descritivo-dedutivo que instruiu a análise da legislação, bem como a doutrina que informa os conceitos de ordem dogmática.PALAVRAS-CHAVE: Direitos humanos; Fluxo migratório; Lei de Migração; Imigrantes; Refugiados; Dignidade humana. This research aims to analyze the 13.445 Act, 24 May 2017 regulated by 9.199 Decree, 20 November 2017 which has explicitly revoked 6.815 Act, 19 August 1980 (Statute of the Foreigner) which has a bias of human rights effectiveness in relation to migrants and refugees in context of a growing migratory flux as well as for integration into Brazilian society as the rights and obligations persons. It’s a theoretical-bibliographical-natured research guided by a descriptive-deductive method which had instructed the analysis of legislation, as well as the doctrine that informs the concepts of dogmatic order.KEYWORDS: Human rights; Migratory flux; Migration Act; Immigrants; Refugees; Human dignity.
