Sexual violence and legal control: a critical view of three sentence extracts on cases of violence against women

Resumo: | In this paper I intend to do two things: first, I will investigate the global organisational structure of three extracts from Brazilian sentences on cases of violence and sexual abuse against women. Second, I will analyse, in one of the three extracts, the notion of grounding, i.e., how the information contained in the extract is divided into more relevant and less relevant facts and events. My aim in carrying out these two kinds of analysis is to investigate how linguistic devices (both at the micro and macro textual levels) help to convey sexist, phallocentric messages in the discourse of the criminal justice system. As far as the methodology is concerned, I will base the analysis of the global structure of sentences on the situation-evaluation pattern (WINTER, 1994), and the analysis of grounding on the concepts and categories presented by Cheng (1991). The analyses results indicate that legal texts from the criminal justice system construct discriminatory subject positions for women. |

Mi objetivo, al realizar estos dos tipos de análisis, es investigar cómo los mecanismos lingüísticos (a nivel micro y macro estructural) ayudan a construir y transmitir mensajes sexistas y falocéntricas, así como el discurso del sistema jurídico criminal. En lo que respecta a su metodología, el análisis de la estructura global de las decisiones judiciales se fundan en el modelo situación-evaluación propuesto por Winter (1994), y el análisis del “anclaje”, en los conceptos y categorías propuestos por Cheng (1991). Los resultados de los análisis demuestran que textos del sistema jurídico criminal construyen posiciones subjetivas discriminatorias para las mujeres.Cet article a comme base deux objectifs: premièrement, celui de fouiller la strucuture organisationnelle globale de trois extraits d’arrêts brésiliens dans des affaires de violence et abus sexuel contre les femmes. Deuxièmement, celui d’analyser dans l’un des trois extraits, la notion d’ancrage (grounding), c’est-à-dire, comment l’information contenue dans un texte est partagée en faits et événements plus importants et moins importants. Mon objectif, au moment de réaliser ces deux types d’analyse, est celui de rechercher attentivement comment les mécanismes linguistiques (dans un niveau à la fois micro et macro structurel) aident à construire et transmenttre des messages sexistes et phallocentriques dans le discours du système juridique criminel. En ce qui concerne la méthodologie, il y a l’analyse de la structure globale des décisions judiciaires centrées dans le modèle situation-évaluation proposé par Winter (1994), et l’analyse de l’ancrage dans les concepts et catégories présentés par Cheng (1991). Les résultats des analyses désignent que les textes du système juridique criminel construisent des positions subjectives discriminatoires envers les femmes.Este artigo tem dois objetivos básicos: primeiro, investigar a estrutura organizacional global de três extratos de acórdãos brasileiros em casos de violência e abuso sexual contra mulheres. Segundo, analisar em um dos três extratos a noção de ancoragem (grounding), isto é, como a informação contida no texto é dividida em fatos e eventos mais relevantes e menos relevantes. Meu objetivo, ao realizar estes dois tipos de análise, é investigar como os mecanismos lingüísticos (em nível micro e macro estrutural) ajudam a construir e transmitir mensagens sexistas e falocêntricas no discurso do sistema jurídico criminal.
