This is a study about the application of the principle of the social function of the company in the face of bankruptcy law, bringing at first a doctrinal analysis to elucidate the historical perpasse and then a sample of jurisprudence to bring up how the Superior Court of Justice has been positioning itself on the main issues involving the matter. The main objective is to show how the guiding principles of the bankruptcy process are applied to the rights of creditors. As for the specific objectives, the main discussions on the subject that went to the Brazilian Superior Court are analyzed. For this purpose, it is based on bibliographical and documentary research, as a methodology employed. One of the main conclusions is that there has been a great evolution, from a world where the bankrupt debtor paid with his or her own life, to a solidified legislation rooted in the preservation of jobs, income, currency turnover and maintenance of business activity. |
