Resumo: The purpose of this monograph was to analyze the controversies surrounding the recent criminal procedure of the custody hearing, specifying the positive and negative points. The method of deductive approach was used initially, starting from a general premise, consistent with the Code of Criminal Procedure and Resolution 213/2015 on the procedure that should occur after the arrest in flagrante specific premise, which is the custody hearing. The type of research used was exploratory, with a qualitative approach and bibliographic procedure, based on doctrines, articles, and current legislation. It was possible to conclude that, for the custody hearing to reach a satisfactory result, the public agencies involved must be strengthened (Police, Public Prosecutor, Judiciary, Public Defender). Only in this way will the custody audience achieve its purpose, which is to combat prison overcrowding, to prevent torture and ill-treatment, to protect detainees' rights with respect for the dignity of the human person, and to do so an advance in criminal proceedings.

Para tanto, utilizou-se o método de abordagem dedutivo, partindo, inicialmente, de uma premissa geral, consistente no que dispõe o Código de Processo Penal e a Resolução 213/2015 sobre o procedimento que deve ocorrer após a prisão em flagrante, para uma premissa específica, que é a audiência de custódia. O tipo de pesquisa empregado foi o exploratório, com abordagem qualitativa e procedimento bibliográfico, baseado em doutrinas, artigos, e na legislação vigente. Foi possível concluir que, para a audiência de custódia alcançar um resultado satisfatório, deve-se ter o fortalecimento dos órgãos públicos envolvidos (Polícia, Ministério Público, Judiciário, Defensoria Pública).
