Summary: Habeas corpus is a constitutional action aimed at ensuring the free exercise of the fundamental right of locomotion. Within the scope of the Supreme Federal Court, according to the Federal Constitution, its jurisdiction is restricted to the cases of authorities that have jurisdiction by prerogative of function or when there is an act of coercion of a higher court. However, the STF has interpreted the hypotheses of habeas corpus in the Court too widely, allowing almost anyone to reach the Supreme Court through the HC. Therefore, it is important to analyze the problems that result from this excessive permissiveness regarding the suitability of habeas corpus in the Supreme Federal Court.

Todavia, o STF tem interpretado de maneira demasiadamente elástica as hipóteses de cabimento do habeas corpus na Corte, permitindo que praticamente qualquer pessoa alcance a Suprema Corte através do HC.
