Resumo: The dualist theory was developed by Alois Brinz at the end of nineteenth century. It breaks down the obligational vinculum into two components: debt (schuld in german) and responsibility (haftung in german). Analyzing roman law excerpts and brazilian Civil Code institutions, this article will seek to demonstrate how the dualistic theory can effectively explain the notion of legal bond in accordance with the rules of brazilian law.
