Law courses: institutional fragmentation, gender and intersectionality

Resumo: | The text addresses the legal academy and its fragmentation, relating them to the hybridization of professionalism. It considers the social diversification of professors – with the incorporation of women and racial difference – as confrontations, encounters and negotiations of identity differences that generate hierarchies and decentralizations. The purpose of the article is to show how these globally widespread processes decentralize the teaching profile, while at the same time they engender the stratification that intersects gender and race with titling, regional location, institutional types and working conditions. Indicators of this displacement, which neither eradicate inequality and domination nor restrict the reproduction of a fixed hegemonic pattern, are presented. The article is based on secondary data on law courses, taken from the National Higher Education Census of 2012, Inep, and illustrates the analysis with qualitative material. |

El texto aborda la docencia del Derecho y su fragmentación institucional, relacionándolas a los hibridismos del profesionalismo. Considera la diversificación social de sus profesores –con la incorporación de las mujeres y de la diferencia racial– como embates, encuentros de diferencias y negociaciones de identidad que generan jerarquizaciones y descentramientos. El objetivo del artículo es mostrar cómo tales procesos globalmente difundidos descentran el perfil docente, mientras engendran la estratificación que ocasiona intersecciones entre género y raza con titulación, localización regional, tipos institucionales y régimen de trabajo. Se presentan indicadores de tal desplazamiento, que no erradican desigualdades y dominación ni tampoco se restringen a la reproducción de un patrón hegemónico fijo. El estudio se basa en datos secundarios sobre los cursos de Derecho, extraídos del Censo Nacional de la Educación Superior de 2012 de Instituto Nacional de Estudos e Pesquisas Educacionais Anísio Teixeira –Inep–, el análisis es ilustrada con material cualitativo. Ce texte met en rapport l’enseignement du Droit et de sa fragmentation institutionnelle, avec les hybridismes propres à la profession. La diversification sociale des professeurs, avec l’incorporation des femmes et de la diversité raciale est perçue comme des enjeux, des rencontres entre differents et des négociations identitaires engendrant des hierarchisations et des décentrements. L´objectif de cet article est de montrer que ces processus provoquent un décentrement du profil enseignant et engendrent une stratification qui de, par son intersectionnalité, recoupe diverses questions telles que celles de genre, race, région, types de institution et régimes de travail. Plusieurs indicateurs de ce déplacement sont presentés ces indicateurs n´eradiquent ni les inegalités ni la domination sans pour autant se limiter a reproduire un modèle hégémonique fixe. L´analyse s´appuye sur des données sécondaires sur des cours de Droit, extraites du recensement National de l’Enseignement Supérieur de l’INEP, 2012, et est illustrée avec un aspect qualitatif. O objetivo do artigo é mostrar como esses processos globalmente difundidos descentram o perfil docente, ao mesmo tempo que engendram a estratificação que intersecciona gênero e raça com titulação, localização regional, tipos institucionais e regime de trabalho.
