Resumo: The present work, seeks through analysis of common material competence, assigned to the Federal Constitution of 1988 to federal entities, verify if its distribution, currently posses a balance and if there were a reduction of inherent conflicts to environmental license. As a result of the distribution of consequences of environmental licenses, enterprises, buildings or potential activities that causes environmental impacts, this competence has always been subject of doubt, mainly in reference to CONAMA Resolution No. 237/97, in content and form. By reviewing the issue of Complementary Law No. 140/2011, which came to regulate, the sole paragraph of Article 23 of the Federal Constitution, treat the cooperation between the federal entities in the common jurisdiction, seeks the present work analyze if the conflicts have been overcome considering the SISNAMA –National Environmental System, introduced by Law nº 6.938/81, pursuing the goals and principles of the National Environmental Policy, that aims to protect a sustainable development

Em consequência da repartição das competências em licenciamento ambiental, de empreendimentos, obras ou atividades potencialmente causadores de impacto ambiental, sempre foi objeto de questionamento, principalmente em referência as atribuições por meio de normas do CONAMA, em especial a Resolução CONAMA nº 237/97, em seu conteúdo e forma.
