Resumo: This monograph dont´t aim to exahaust the doctrinal and jurisprudential controversies about desconsiderating of legal personality in labor law, but to analyze this importante topic in a clear and objective legal fundamentals, doctrine and jurisprudence. Given that we are dealing with the personality of the legal person, firstly is conceptualize and classify all the different types wich exist in our legal system, including, associations, foundations, companies in the third sector, corporate companies, among others. After the fisrt part of this monograph, we will expose the issue of desconsiderating of legal personality, recent matter in our law, wich firstly was set out in CLT – “Consolidação das Leis do Trabalho”, gaining strength with stabilishiment of the Consumer Protection Code in 1990 and the Civil Code in 2002. In this part of the monograph will set the theme and understand it, these requirements needed to best apply it. Finally, we will discuss this issue specially about the Labor Law view and will analyze the members company responsibility

Finally, we will discuss this issue specially about the Labor Law view and will analyze the members company responsibilityO presente trabalho não tem como objetivo exaurir todas as controvérsias doutrinárias e jurisprudenciais acerca da desconsideração da personalidade jurídica no direito do trabalho, mas sim analisar de forma clara e objetiva os fundamentos legais, doutrinários e jurisprudenciais atinentes a este importante tema.Tendo em vista que estamos tratando da personalidade da pessoa jurídica, ou seja, da empresa, importante e necessário, primeiramente, conceituarmos e classificarmos todos os diversos tipos existentes em nosso ordenamento jurídico, entre elas, as associações, as fundações, as empresas do terceiro setor, as sociedades empresárias, entre outras.Finda essa primeira parte da monografia, passaremos a expor o tema da desconsideração da personalidade jurídica, matéria essa considerada recente em nosso Direito, tendo sua primeira previsão legal estatuída na CLT – Consolidação das Leis Trabalhistas, ganhando força com a promulgação do Código de Defesa do Consumidor em 1990 e do Código Civil em 2002.
