Resumo: | RESUMO: Em Portugal, existe um ordenamento jurídico de tipicidade europeia continental. Assim, de uma forma resumida, temos o poder executivo, dividido pelo Presidente da República e o Governo; o poder legislativo residente no Parlamento; e o poder judicial no qual podemos incluir a Magistratura Judicial e a Magistratura do Ministério Público. São estas funções dentro do Estado de Direito social e democrático português que vamos analisar do ponto de vista da Constituição da República Portuguesa. Vamos perscrutar o juiz e o procurador do Ministério Público. Vamos nos debruçar sobre o acesso, em Portugal, a estas carreiras profissionais, assim como o acesso ao Supremo Tribunal de Justiça e os respectivos “órgãos reguladores”: Conselho Superior de Magistratura e Conselho Superior do Ministério Público, bem como o Conselho Superior dos Tribunais Administrativos e Fiscais. Nessa perspectiva, vamos identificar como essas instituições protegem os direitos fundamentais. / ABSTRACT: In Portugal, there is a legal system of typicity of continental Europe. Thus, in a brief way, the executive power is divided by the President and the Government; the legislative power resides in Parliament; and the judiciary power in which we can include both the Judicature and the Prosecution. These are the functions within the Social and Democratic Portuguese State that we are going to analyze from the point of view of the Portuguese Constitution. At first, roles of judges and prosecutors are to be fully studied; then our scope will aim to the access, in Portugal, to such careers as well as to the Supreme Court and the respective responsible agencies, which are: Superior Council of Magistracy and Superior Council of the Public Ministry, as well as the Superior Council of the Administrative and Fiscal Courts. Having said that, our final goal will be to identify how these institutions act to protect fundamental rights. / RESUMEN: En Portugal, existe un orden legal de tipicidad europea continental. Converge certa explosão de demandas judiciais, em que pessoas e instituições buscam nesta dimensão do poder estatal proteção para seus interesses/direitos. Desse modo, o Poder Judiciário tem sido objeto de estudos e pesquisas cada vez mais intensos. Poder-se-ia afirmar que esta realidade não é nova, visto que a busca pela proteção do juiz também preocupou autores da antiguidade. Aristóteles já constatava que “quando ocorrem disputas, as pessoas recorrem ao juiz. Recorrer ao juiz é recorrer à justiça, pois a natureza do juiz é ser uma espécie de justiça animada”, ou seja, na busca do juiz, as pessoas obterão o justo meio, simbolizado pela figura desta autoridade.1 Contudo, em nossos dias, constata-se a ascensão das atividades judiciárias, fenômeno que se desenvolveu nas últimas décadas do século XX e neste início do século XXI. Neste sentido, Antoine Garapn constatou que, no final do século XX, começou a ocorrer uma verdadeira explosão do contencioso e, com isso, as jurisdições cresceram e se multiplicaram, diversificando e afirmando, cada dia um pouco mais, sua autoridade. Em tal contexto, “os juízes tem sido chamados a se manifestar em um número de setores da vida social cada dia mais extenso.”2 . Assim, diante desse movimento lento, porém inexorável, cresceu importância de se estudar a organização, o funcionamento e o poder exercido pela magistratura. Ao lado desse fenômeno, assistiu-se a intenso processo de fortalecimento do Ministério Público. Com atuação em defesa de bens e direitos caros à sociedade, essa dimensão estatal ampliou seu espaço de atuação e detém poderes com legitimidade constitucional. As carreiras das Magistraturas Judicial e do Ministério Público têm, no Ordenamento Jurídico Português, especificidades muito próprias. O acesso a estas carreiras profissionais tem igualmente regras muito precisas de acordo também com a defesa do interesse nacional português. O que em nada fica prejudicado pelo facto de Portugal ser um país plenamente integrado na União Europeia e na própria moeda única, o Euro. Bem pelo contrário. Vale registrar, desde logo, que Magistratura e Ministério Público não podem receber pressões ilegítimas em suas atuações3.
