Summary: In this work I analyze, from the beginning to the end of procedural relations, the practical results of judicial decisions, mainly their subjective and binding effects. I argue that anticipated effects of Judicial Protection in spite of its intense use and consequent surcharging of courts remains a very important tool. Although Class Action is the best way to achieve, social results, some restrictions in the law threat the fulfillment of the constitutional principle concerning public civil action and consumer protection. The overcoming of obstacles in Judiciary procedures challenges judges to apply extensively their duties in conducting trials according to the rule of reasonable length which is guaranteed in Brazilian Constitution, and so far by effective tutelage.

Começa por demonstrar a importância da antecipação dos efeitos da tutela, não obstante o impacto da utilização intensiva do instrumento, em paralelo com a nova sistemática do agravo, que sobrecarregou os tribunais. Destaca a necessidade de se interpretar o alcance das liminares e da sentença, nas ações coletivas, em harmonia com os princípios e garantias estabelecidos na Constituição Federal para proteção dos interesses coletivos e difusos e dos direitos homogêneos. Aprecia as diversas espécies de execução, inclusive a de quantia certa, fundada em título judicial, especialmente quanto à funcionalidade das alterações introduzidas pela Lei 11.232/06. Avalia os pontos de estrangulamento do Poder Judiciário 1e as condutas adequadas a serem observadas pelos profissionais dos ramos jurídicos para que os princípios da inafastabilidade da tutela jurisdicional e da duração razoável do processo se transmudem de quimera em realidade, e não apenas para o demandante ter certificado o seu direito, mas para satisfazê-lo, o que resulta na tutela efetiva. Encerra com o exame do projeto de reforma da execução fiscal e a constatação da necessidade de interligação do procedimento administrativo e do processo judicial, com o objetivo de, aplicados os princípios constitucionais, eliminarem-se as repetições indevidas de atos e se proporcionar a tutela efetiva já no processo administrativo, o que resultaria na redução da demanda judicial. Busca-se, pois, a compreensão da efetividade da tutela jurisdicional e da autotutela administrativa, como uma sistemática que abrange diversos tipos de processo e está alicerçada nos direitos fundamentais.Made available in DSpace on 2017-06-01T18:18:00Z (GMT).
