Monografia (graduação) - Universidade Católica de Brasília, Brasília, 2008.https://repositorio.ucb.br:9443/jspui/handle/10869/3732DireitoO presente estudo é uma análise sucinta sobre o instituto do monitoramento eletrônico de presos por dispositivos rastreadores através do sistema de posicionamento global (GPS), dentro das leis vigentes, traçando um paralelo entre a Constituição Federal e a Lei n° 7.210/1984 – Lei de Execução Penal, Decreto-Lei nº. 2.848/1940 – Código Penal, Decreto-Lei nº. 3.931/1941 – Código de Processo Penal, e ainda a respeito de alguns Projetos de Lei que estão em trâmite no Congresso Nacional, em síntese o PLS nº.641/2007 e o PLS nº. 175/2007. Inevitável o conhecimento doutrinário no que tange ao princípio constitucional da dignidade da pessoa humana e os direitos humanos fundamentais em relação ao apenado. Analisando posicionamentos doutrinários que regem a matéria, bem como as divergências jurídicas no que concerne à vigilância do preso através do uso de pulseiras ou tornozeleiras eletrônicas. Procura ainda despertar um olhar social com o mínimo de conhecimento sobre a massa carcerária que compõe o sistema prisional no Brasil. Contudo cabe ressaltar a impossibilidade de esgotamento do presente assunto através deste trabalho, haja vista as constantes mudanças sociais que são inerentes a todas as sociedades. Entretanto é de suma importância o conhecimento indisciplinar que rege a matéria no direito brasileiro.The present study is a brief analysis on the institute of the electronic monitoramento of having arrested for devices rastreadores through the system of global positioning (GPS), inside of the effective laws, drawing a parallel one between the Federal Constitution and the Law n° 7.210/1984 - Law of Penal Execution, Law no.. 2.848/1940 - penal code, Law no.3.931/1941 - code of Penal Process, and still regarding some Bills that are in path in the National Congress, in synthesis PLS nº.641/2007 and the PLS no.175/2007. inevitable the doctrinaire knowledge with respect to the constitutional beginning of the human person's dignity and the fundamental human rights in relation to the apenado. Analyzing doctrinaire positionings that you/they govern the matter, as well as the juridical divergences in what concern to the prisoner's surveillance through the use of bracelets or electronic ankle supports. It still seeks to wake up a social glance with the minimum of knowledge on the prison mass that it composes the system prisional in Brazil. However it fits to emphasize the impossibility of exhaustion of the present subject through this work, have seen the constants social changes that you/they are inherent the all of the societies.
