Theory of direct horizontal effectiveness of fundamental rights and their recognition in Brazil analysis

Resumo: The article aims to analyze the effectiveness of fundamental rights, their recognition and their applicability in Brazil, given the constitutional provision in the sense that the rules defining fundamental rights and guarantees have immediate application. For this, the first part presents the effectiveness of fundamental rights, pointing out their concept and other particularities, in addition to listing the species of the effectiveness genre such as vertical effectiveness and horizontal effectiveness - the latter comprising diagonal effectiveness. Later, it discusses the main existing theories to justify the (in)effectiveness of fundamental rights to private relations, which are the doctrine of state action, indirect horizontal effectiveness and direct horizontal effectiveness. Finally, it deals with the recognition and applicability of the theory of direct horizontal effectiveness in Brazil, identifying some significant examples in brazilian jurisprudence and, consequently, presenting the conclusions. Regarding the research methodology, we opted for the deductive method, through documental, bibliographical and jurisprudential reading and analysis.

Regarding the research methodology, we opted for the deductive method, through documental, bibliographical and jurisprudential reading and analysis.O artigo tem o objetivo de analisar a eficácia dos direitos fundamentais, o seu reconhecimento e a sua aplicabilidade no Brasil, haja vista a previsão constitucional no sentido de que as normas definidoras dos direitos e garantias fundamentais têm aplicação imediata. Para isto, a primeira parte apresenta a eficácia dos direitos fundamentais, pontuando sobre o seu conceito e outras particularidades, além de elencar as espécies do gênero eficácia como a eficácia vertical e a eficácia horizontal - compreendendo, esta última, a eficácia diagonal. Posteriormente, discorre o estudo sobre as principais teorias existentes a justificar a (in)eficácia dos direitos fundamentais às relações privadas, que são a doutrina da state action, a eficácia horizontal indireta e a eficácia horizontal direta. Por último, trata sobre o reconhecimento e a aplicabilidade da teoria da eficácia horizontal direta no Brasil, identificando alguns exemplos significativos na jurisprudência brasileira e, por consequência, expõe as conclusões.
