Defesa: Curitiba, 27/03/2015Inclui referências : f. 201-213Resumo: A preocupação central do presente trabalho é a de que o Judiciário lida com problemas estruturais, que são policêntricos e altamente complexos, mas o faz por meio de um processo bipolarizado, que é completamente inadequado para tanto. Três razões evidenciam a necessidade de repensar o processo e a forma de atuação jurisdicional. A primeira delas decorre do plano material: os casos estruturais, em razão de suas características, não se amoldam à lógica bipolar. Em segundo lugar, esses casos não podem ser simplesmente afastados do Judiciário, pois o fenômeno é muito mais complexo que um suposto voluntarismo judicial que "intervém" em campos além do espaço jurídico, e por isso é urgente repensar a atual prática judiciária, pois ainda é marcada pela bipolarização. A terceira razão liga-se à necessidade de aprimorar a capacidade do Judiciário, demonstrando que parte das críticas à capacidade institucional deriva do modelo processual adotado, bipolarizado e individualista. Assentadas essas premissas, outra lógica processual é proposta, partindo da análise das structural injunctions estadunidenses e do experimentalismo, abordagem do fenômeno estrutural defendida por Charles F. Sabel e William H. Simon. O processo coletivo-estrutural deve ser construído sobre os elementos de participação e negociação, foco nos resultados, flexibilidade e transparência. Esse outro modelo processual é marcado pela flexibilização processual, que engloba a maleabilidade da demanda - possibilitando inclusive a coletivização - e a multipolaridade processual, que decorre da ampla participação dos interessados, cogitando-se a existência, além disso, de uma transpolaridade, com a migração das partes de um polo a outro da relação processual. O gerenciamento procedimental permite a construção do procedimento adequado ao caso concreto. A oralidade é uma de suas características marcantes, expressadas especialmente pelo importante papel das audiências (incluindo audiências públicas), que podem ter diversas funções. A cisão entre conhecimento e execução é colocada em xeque pelo processo coletivo-estrutural, pois as duas atividades nele convivem, e de maneira continuada. Assim, a aplicação do instituto da coisa julgada também é desafiada, já que pressupõe a existência de uma declaração completa e definitiva que "resolve o litígio". Palavras-chave: Processo coletivo; problemas estruturais; litígios estruturais; structural injunctions; flexibilização processual; gerenciamento procedimental; experimentalismo.Abstract: The main idea of the present master thesis is that the Judiciary deals with structural problems, which are highly complex and polycentric, but does it through the bipolar procedure, which is absolutely inadequate. Three reasons evidentiate the need to rethink this procedure and adjudication as a whole. The first one arises from the substantive perspective: structural cases do not fit into bipolar logic. Secondly, these cases cannot simply be withdrawn from the Judiciary, for the phenomenon is much more complex than the so-called "judicial voluntarism" that "interferes" in fields outside the law, and so it is urgent to rethink the judicial practice, because it still operates on the bipolar logic. The third reason is connected to the need to improve the institutional capacity of the Judiciary, indicating that part of the critique to this phenomenon derives from the bipolar and individualistic procedure standards. Upon these premises, a new procedural logic is designed through the analysis of American structural injunctions and experimentalism, the approach proposed by Charles F. Sabel and William H. Simon. The structural collective procedure should, therefore, be built upon participation and negotiation, focus on results, flexibility and transparency. The new procedural model is marked by the procedural flexibility, defined by claim malleability, which allows collectivization and claim plasticity; and by procedural multipolarity, permitting full participation of all interested subjects, also suggesting the existence of transpolarity, allowing parties to migrate from one pole to another. Procedural management permits the construction of a proceeding that is adequate to the case. Orality is one of its definitive features, expressed by the occurrence of hearings (including public hearings), which have multiple functions. The division between the adjudicative and remedial phases of the procedure is also questioned by the structural collective procedure: there are no separate phases. Therefore, the concept of res judicata is challenged, for it presupposes a final, complete declaration to "resolve the dispute."
