Centro de Ciências Jurídicas. Direito.A atividade regulatória estatal sempre foi marcada pela sua mutação, principalmente em virtude do modelo de Estado adotado em cada sociedade. A ineficácia estatal em prover serviços de qualidade, juntamente com as necessidades crescentes da população por melhores condições, fez com que no Brasil, a partir da década de 1990, especificamente, os serviços antes prestados pelo Estado fossem passados para particulares, surgindo, assim, entidades que, dotadas de personalidade jurídica, começaram a ser incumbidas de regular e fiscalizar os setores concedidos, bem como de setores que possuíssem sensibilidade para com a coletividade. O modelo adotado foi o das agências reguladoras, provenientes dos Estados Unidos da América, marcadas, principalmente, por sua autonomia frente ao Poder Executivo. Dotadas de poder normativo, as agências reguladoras brasileiras são criadas por lei, as quais estabelecem standards, e têm sua legitimidade democrática através das previsões contidas nas próprias leis instituidoras, trazendo ampla participação da sociedade na tomada de decisões, caracterizadas por seu conteúdo técnico e não político.The state regulatory activities have always been marked by its own mutation, primarily due to the state model adopted in each society. The state inefficacy in providing quality services, along with the population’s continuous need for better conditions, made Brazil, starting in the 1990s, specifically, pass services provided by the state to private companies, thus creating entities with legal personality entrusted with the power to regulate and oversee the sectors bestowed, as well as sector that enjoyed sensibility towards the community. The model adopted was that of the regulatory agencies derived from United States of America, marked mainly by its autonomy before the Executive Power.
