Outsourcing and Precarization of Labor in the Public Policy of Social Assistance

The Federal Constitution of 1988 elevated Social Assistance (SA) to the condition of public policy. The following years revealed significant legal advances that refer it as a right and broaden the discussions around its working process. This research seeks to analyze the work management in the SA, concerning the outsourcing. For that, a bibliographical and documentary research was done, based on qualitative reading and inspired by historical materialism. It was observed that the SA has a set of norms (NOB / RH / SUAS, of 2006, National Typification of Services, of 2009, Law 12.435 / 2011, NOB / SUAS, of 2012) that establishes parameters of professionalization, improvement of connections, with a special focus on the end of outsourcing, and decent working conditions in its scope, representing the means and instruments for work management. However, the material and institutional conditions indicate a dissonance between the legal elements and the reality of the workers, who live with the precariousness of work and the workers. The precariousness linked to outsourcing is coupled with the deepening of improvised and insufficient structures; turnover, overexploitation of outsourcers, which compromises the quality of services offered to users, as outsourcing the rights mediated by two distinct institutions in an idiosyncratic mix of public and the private, and can deprive it as a space of law.
