Tendo como alicerce os conceitos de matriz tributária e a propriedade como direito pós-tributação, buscou-se assentar a temática em questão não somente nos aspectos objetivos e formais da lei, mas sim no que tange aos contextos social, político e econômico, de modo que se possa promover uma análise eficaz sobre a questão. A partir de considerações doutrinárias e jurisprudenciais, demonstrou-se a natureza jurídica tributária do empréstimo forçado, de maneira que os princípios e regras que compõem o Direito Tributário são a ele aplicáveis. Ademais, fazendo uso de estudos econômicos e econométricos, constatou-se a baixa qualidade da infraestrutura brasileira e a necessidade de investimentos no setor, uma vez que o empréstimo compulsório se tornou entrave para o desenvolvimento econômico e social do país. Assim, percebe-se a necessidade da validação do uso deste modal de empréstimo como uma figura tributária viável, adequada e preferível, para que se arrecade os recursos necessários em prol dos investimentos na infraestrutura brasileira. Concluiu-se que o empréstimo compulsório pode atender perfeitamente todos os pressupostos objetivos e formais contidos no artigo 148, inciso II da Constituição Federal de 1988. _____________________________________________________________________________ ABSTRACTThe objective of this study was to deal with a tribute little discussed by the doctrine and that haven’t been used in a long time: the compulsory loan. Having as a foundation the concepts of tax matrix and property as an after-tax right, it sought to settle the question not only in the objectives and formal aspects of the law, but also taking into account the social, political and economical context, so that it can promote effective analysis of the question. From doctrinal and jurisprudential considerations, it proved the tax legal nature of forced loan, so that the principles and rules that make up the Tax Law are applicable to it. Moreover, making use of economic and econometric studies, it is found the low quality of Brazilian infrastructure and the need for investments in the sector, since the low quality infrastructure became obstacle to economic and social development of the country. Thus, we see the need for the use of validation of this loan as a viable tax figure, suitable and preferable for that collects the necessary resources to support investments in Brazilian infrastructure.
