Resumo: The text analyses the fundamental principle of the dignity of the human person and its performance as a general clause of protection of the personality. For that, it uses a descriptive and deductive methodology, based fundamentally on bibliographic and legislative research. The paper initially presents a brief evolution of the idea of dignity. It investigates the existential relation between the constitutionalisation of private law and the inclusion of the human dignity as a constitutional principle. It also examines the distinction between general clauses and principles, but makes it clear that the human dignity is, at the same time, a general clause and a principle. Finally, results demonstrate the importance of recognizing the human dignity as a true general clause of protection and promotion of the human person.

En el texto se analiza el principio fundamental de la dignidad de la persona humana y su actuación como cláusula general de tutela de la personalidad. Para tanto, se utiliza de metodología descriptiva y deductiva, basada fundamentalmente en revisión bibliográfica y en la investigación de la legislación. El estudio presenta inicialmente una ligera evolución de la idea de dignidad. Investiga la relación existente entre la constitucionalización del derecho privado y la inclusión de la dignidad de la persona humana como un principio constitucional. Trata también de la distinción entre las cláusulas generales y los principios, pero deja claro que la dignidad de la persona humana es, a la vez, una cláusula general y un principio. Por fin, los resultados alcanzados apuntan a la importancia del reconocimiento de la dignidad de la persona humana como verdadera cláusula general de tutela y promoción de la persona humana. O trabalho apresenta inicialmente uma breve evolução da ideia de dignidade. Investiga a relação existente entre a constitucionalização do direito privado e a inclusão da dignidade da pessoa humana como um princípio constitucional. Trata também da distinção entre as cláusulas gerais e os princípios, mas deixa claro que a dignidade da pessoa humana é, ao mesmo tempo, uma cláusula geral e um princípio. Por fim, os resultados alcançados demonstram a importância do reconhecimento da dignidade da pessoa humana como verdadeira cláusula geral de tutela e promoção da pessoa humana.
