The trajectory of sanitary regulation for the use of the lactase enzyme in food products in Brazil

Resumo: Objective: Analyze the trajectory of sanitary regulation of lactase in food products in Brazil. Methodology: This is an exploratory-descriptive, qualitative research, carried out from the analysis of sanitary regulations and secondary public access data on food records and patents. Results: It was observed that the 24 normative acts presented weaknesses and inconsistencies that allowed the transition from the use of lactase as a supporting element in food technology, to deliberate use in food products registered in different categories. Among these categories, foods with functional property or health claims and food supplements containing probiotics and/or enzymes predominated. In addition, it was verified the patent registration of the medicine by the manufacturer, orodispersible tablet containing lactase as active principle, and subsequent registration of the food product with Anvisa, containing the enzyme, with functional/health claim. Conclusion: In short, the findings evidenced the redirection of the use of lactase from the pharmaceutical market to the potential food market, as well as failures in guidance for consumer safety, for which conflicts of interest and precedents for its indiscriminate marketing are recognized.

Metodología: Se trata de una investigación exploratoria-descriptiva, cualitativa, realizada a partir del análisis de normativas sanitarias y datos de acceso público secundario sobre registros y patentes alimentarias. Resultados: Se observó que los 24 actos normativos presentaban debilidades e inconsistencias que permitieron la transición del uso de la lactasa como elemento de apoyo en la tecnología alimentaria, al uso deliberado en productos alimenticios registrados en diferentes categorías. Entre estas categorías, predominaron los alimentos con declaraciones funcionales o de propiedades saludables y los complementos alimenticios que contienen probióticos y/o enzimas. Además, se verificó el registro de patente del medicamento por parte del fabricante, comprimido bucodispersable que contiene lactasa como principio activo, y posterior registro del producto alimenticio ante Anvisa, que contiene la enzima, con declaración funcional/saludable. Conclusión: En definitiva, los hallazgos evidenciaron el redireccionamiento del uso de lactasa del mercado farmacéutico hacia el potencial mercado de alimentos, así como fallas en la orientación para la seguridad del consumidor, por lo que se reconocen conflictos de interés y precedentes para su comercialización indiscriminada.Objetivo: Analisar a trajetória da regulação sanitária da lactase em produtos alimentícios no Brasil. Metodologia: Trata-se de uma pesquisa exploratória-descritiva, qualitativa, realizada a partir da análise de normativas sanitárias e dados secundários de acesso público sobre registros de alimentos e patentes. Resultados: Observou-se que os 24 atos normativos apresentaram fragilidades e inconsistências que permitiram a transição do uso da lactase como coadjuvante de tecnologia alimentar, para utilização deliberada em produtos alimentícios registrados em categorias distintas. Dentre estas categorias, predominaram os alimentos com alegações de propriedade funcional ou de saúde, e suplementos alimentares contendo probióticos e/ou enzimas. Ademais, constatou-se o registro de patente de medicamento pelo fabricante, pastilha orodispersível contendo lactase como princípio ativo e, posterior registro de produto alimentício junto à Anvisa, contendo a enzima, com alegação de propriedade funcional/saúde.
