Ações afirmativas para inclusão de pessoas com deficiência no mercado de trabalho: um estudo sobre concursos públicos

Resumo: This study aimed to reflect on the effectiveness of Jobs Reservation in public tenders, while affirmative action policy, directed to the segment of the population with disabilities; on the relationship between education / schooling and the job market for people with disabilities from the comparison of results obtained in the competitions for candidates with and without disabilities who competed for positions of Analyst and Judicial Technician - Administrative Area (from Federal Justice and Labor Justice), made in the period of 2010- 2014, taking as research environment, the (34) results of related public tenders, conducted by Carlos Chagas Foundation. Specific objectives were defined based on the (421) municipal, state and federal public tenders conducted from 2000 to 2014: check the evolution of people with disabilities participation; map and characterize, by sex and age, the overall demand for candidates with and without disabilities; Federal Decree # 3298/1999 was analyzed with regard to book places in public tenders, seeking to trace their changes over the years, due to the actions of civil society and public prosecutor. Among 34 selected public tenders, identified the type of disability and the type of adaptation required by the candidate to do the examinations, which allowed us to outline the profile of candidates with disabilities who participated and those who have succeeded along the public tenders. The results showed that despite the legal standard to provide 5% reservation of seats offered, the participation of people with disabilities is low, reaching only 1% in 2013; even if the disabled candidates competing for the total vacancies in dispute, and concomitantly the reserved places, the population ends up competing with each other, therefore, based on the classification of these candidates, it appears that performance on tests is much less than expected to compete in wide competition, bringing up the issue of this population the quality of education in relation to other students. Among the candidates with disabilities, which were approved in public tenders, only 3% would have been approved if there were not reserved places. Among those who are enabled, due to reserved openings, most have mild disability that does not require any kind of adaptation to perform the examination. For the candidate with most severe disabilities, it appears that in 34 public tenders done in five years, among the qualified ones in the general list, only three individuals were blind, two wheelchair users and, there was no deaf candidate. Data, which confirms the need to monitor and evaluate the educational inclusion policies as well as the one geared to the job market, as we are aware such action has not been able to support people with more severe disabilities, who would be the main recipients of this policy.

Data, which confirms the need to monitor and evaluate the educational inclusion policies as well as the one geared to the job market, as we are aware such action has not been able to support people with more severe disabilities, who would be the main recipients of this policy.Este estudo objetivou refletir sobre a efetividade da Reserva de Vagas em concursos públicos, enquanto política de ação afirmativa, direcionada ao segmento da população com deficiência; sobre a relação entre educação/escolarização e mercado de trabalho para pessoas com deficiência, a partir da comparação dos resultados obtidos nos concursos pelos candidatos com e sem deficiência que concorreram aos cargos de Analista e Técnico Judiciário – Área Administrativa (da Justiça Federal e da Justiça do Trabalho), realizados no período de 2010 a 2014, tomando como universo da investigação os resultados dos respectivos (34) concursos públicos, realizados pela Fundação Carlos Chagas. Foram definidos como objetivos específicos, com base nos (421) concursos públicos, (de âmbitos Municipal, Estadual e Federal) realizados no período de 2000 a 2014: verificar a evolução da participação de pessoas com deficiência; mapear e caracterizar, por sexo e faixa etária, a demanda geral dos candidatos com e sem deficiência; o Decreto Federal nº 3298/1999 foi analisado, no que tange à reserva de vagas em concursos públicos, procurando demarcar suas alterações ao longo dos anos, em razão de ações da sociedade civil e do Ministério Público. Dos 34 concursos públicos selecionados, identificou-se o tipo de deficiência e o tipo de adaptação requerida pelo candidato para a realização das provas, o que permitiu traçar o perfil dos candidatos com deficiência que participaram e, daqueles que lograram habilitação nos concursos. Os resultados apontaram que apesar da norma legal prever a reserva de 5% das vagas ofertadas, a participação de pessoas com deficiência é baixa, tendo atingido 1% apenas em 2013; mesmo que os candidatos com deficiência concorram ao total de vagas em disputa, e concomitantemente, às vagas reservadas, essa população acaba concorrendo entre si, pois, com base na classificação desses candidatos, verifica-se que o desempenho nas provas está aquém do esperado para competir na ampla concorrência, trazendo à baila a questão da qualidade da educação dessa população em relação aos demais alunos. Dentre os candidatos com deficiência que foram aprovados nos concursos, apenas 3% teriam sido aprovados se não existisse a reserva de vagas. Dentre aqueles que conseguem habilitação, em razão da reserva de vagas, a maioria tem deficiência leve que não requer nenhum tipo de adaptação para realização da prova. Em relação aos candidatos com deficiências mais severas, constata-se que, nos cinco anos e nos 34 concursos analisados, dentre os habilitados na lista geral, estavam apenas três cegos, dois cadeirantes e, nenhum candidato surdo.
