OBJECTIVE: Analizar la posibilidad de extender la cosa juzgada a terceros, que no son partes en el proceso, en vista de la resolución de la cuestión preliminar resuelta en la solicitud, con base en el régimen adoptado por el Código de Procedimiento Civil / 2015. METHOD: This is an exploratory research with a qualitative approach; as for the procedure it is classified as bibliographic, from the analysis of the doctrine pertinent to the study. RESULTS: The res judicata can be conceptualized as an effect that makes the declaratory content of the sentence immutable. The formal res judicata concerns the immutability of the judicial decision within the process in which it was rendered, and the material res judicata reflects the indisputability of the judicial decision in the process in which it was rendered and in any other. Harmfulness is characterized by the subordination of a legal question to the one that logically precedes it, so that the decision on the first one is able to determine the content of the judicial provision regarding the second or to prevent any decision, depending on whether it is preliminary or harmful. CONCLUSION: It was concluded that immutability, due to res judicata, affects harmful questions of merit, decided expressly and incidentally in the process, provided that the requirements listed in art. 503 of the Civil Procedure Code, reaching legally interested third parties.
