Manipulação genética face ao princípio da dignidade da pessoa humana: implicações éticas e jurídicas

Resumo: The present monographic work aims to analyze the development of scientific research in the field of genetic manipulation, especially genetic engineering techniques, its feasibility and its potential in relation to the Principle of Human Dignity and the ethical and legal implications that permeate this biotechnology. For the development of the study, the method used was the qualitative method, since a universe of meanings, concepts, motives and values were observed, which guide the social reality of scientific research, starting from general premises to reach the particularities of the specific case. Regarding the level, the research fits the exploratory field, since it involves an in-depth bibliographical survey on the problem in question and aims at the improvement of ideas, in order to obtain precise considerations about the genetic manipulation with human beings. In addition, the present monographic work used bibliographical research, analyzing books, scientific articles, national and international legal order, as well as doctrinal interpretations. Through the study, it was obtained that the practice of genetic manipulation, especially genetic engineering techniques involving human beings, may violate the Constitutional Principle of the Dignity of the Human Person in the light of bioethics and law. In this way, it is concluded that it is essential to create legislation that effectively prohibits the use of research in the field of genetic manipulation that has purposes that threaten human dignity, that is, legislation that acts as a reduction of potential negative risks of this biotechnology, aiming to impose ethical-legal limits on genetic manipulation, establishing norms on how scientific research should be developed with the use of human embryos in the field of genetic manipulation, in order to effectively protect the dignity of the human person.

Para o desenvolvimento do estudo, o método de abordagem utilizado foi o qualitativo, uma vez que se observou um universo de significados, conceitos, motivos e valores, que norteiam a realidade social das pesquisas científicas, partindo-se de premissas gerais para chegar às particularidades do caso concreto. Já quanto ao nível, a pesquisa se encaixa no campo exploratório, visto que envolve um levantamento bibliográfico aprofundado a respeito do problema em questão e tem como objetivo o aprimoramento de ideias, a fim de obter considerações precisas sobre a manipulação genética com seres humanos. Além disso, o presente trabalho monográfico utilizou a pesquisa bibliográfica, procedendo-se à análise de livros, artigos científicos, do ordenamento jurídico nacional e internacional, bem como de interpretações doutrinárias. Por intermédio do estudo realizado, obteve-se como resultado que a prática da manipulação genética, em especial as técnicas de engenharia genética que envolvem seres humanos podem violar o Princípio Constitucional da Dignidade da Pessoa Humana, à luz da bioética e do Direito.
