This work as an object to analyze the validity of the disciplinary sanction of revocation of retirement. The statutory civil servants when committing a serious functional infraction when on active duty will be subject to this penalty if at the time of the decision the civil servant is retired. This work aims to demonstrate the process of accountability of the civil servant through the Disciplinary Administrative Process, analyze the application of the disciplinary sanction of revocation of retirement and compare positions contrary and favorable to this penalty. It will also be addressed the withdrawal of retirement before absolution in the criminal sphere, in order to elucidate the interdisciplinarity of the subject, as well as to demonstrate the current understanding of our jurisprudence on the subject. This work will have a scientific approach on the subject, where the bibliographic and documentary research method will be used for its elaboration. It is a current issue and one that generates divergence between indoctrinators, has no consolidation in the national courts and deserves a new analysis of its applicability, where the constitutional changes and the principles of human dignity and proportionality need to be analyzed so that then the application of the retirement penalty may be validated.
