Monografias "terceirizadas": quais possíveis consequências acadêmicas e jurídicas?

The theme of this present research paper is about "Outsourced" Monographs: what are the possible academic and legal consequences for it? The main objective is to define what academic, criminal and civil consequences that can be attributed to the student when this fact is really proved about "outsourcing" of his monograph. The methodology used to develop this research paper was the bibliographical and documentary research, it was based on articles and monographs already published that deal with this theme. Through the deductive methodology, under the legal aspect the incidence of this phenomenon and other frauds such as plagiarism, (autoplagio, forgery and ghost writer. In addition, it shows us the academic dishonesty presents in the academic research paper and also reflects on ethics and morality. Nowadays these values are absent in the scientific research area. This research also analyzes and explains other types of fraud, as well as its characteristics and consequences. It is concluded that the lack of specific legislation attributes the academic the feeling of impunity. The academic consequences can range since the professor’s jury failure until the student’s expulsion from the university. As a civil consequence, the student can respond to the provisions of the articles 102, 103, 104 and 108 of the Law number 9.610 / 1998. Finally, criminally, the academic can be classified by equating in the crimes exposed in articles 299, 304 and 307; all of them are in the Penal Code. However, the lack of specific legislation associated with the lack of cases brought to the judiciary it becomes doubtful the consequence in this concrete case.
