This monograph aims to demonstrate and analyze the form and procedures used by the public administration, through the transit body, in the administrative process of suspension of the National Driver's License, when one of the hypotheses that generates the opening of the suspension process. In this way, it verifies compliance with the principles of adversary proceedings and ample defense in administrative suspension proceedings. To this end, the study seeks to identify the legal diplomas applicable to the administrative process, and it is also verified regarding the doctrinal concepts of the above principles. In continuation the research falls on the procedure used by the competent authority for the determination of the faults committed, being specified as to the possibility of presentation of defense and resources on the part of the administered ones. From this, a relationship is established between the aforementioned principles and their faithful fulfillment in the administrative processes of suspension of the municipality of Braço do Norte referring to the period of the year 2017. Thus, it intends at present to verify about the observance of the principles of the adversary and the ample defense in these administrative processes.
