ABSTRACT The present monographic work aims to analyze the criminal implications of the medical professional who makes an error in the exercise of his profession. For that, a qualitative research was carried out, regarding the exploratory level and the bibliographical and documentary procedure, using mainly doctrines and legislation. It was found that when a medical error occurs, people only seek the civil liability of these professionals, with a view to pecuniary reparation of the damage, but in the criminal process itself, the judge may in the sentence arbitrate a value to reimburse the damages caused to the victim . Finally, it is concluded that there is a possibility of criminal liability of the physician in the exercise of his profession, which could have a more effective punitive effect, reducing the recurrence in this type of medical conduct that generates so much damage.
