OBJECTIVE: To analyze the decisions of the Santa Catarina Court of Justice on the recognition of socio-affective paternity. METHOD: As for the level, the research is exploratory, as it aims to identify which are the positions of origin or lack of precedence for the recognition of socio-affective fatherhood. Regarding the approach used, the method was qualitative. The procedures employed were bibliographic and documentary research. RESULTS: The plurality of contemporary relationships causes the most diverse family groups to emerge. In this bias, the fundamental importance of the affective bond in relationships is based, based on coexistence, dedication and reciprocal companionship and the principle of affectivity. CONCLUSION: It was found that, in the majority, when there is proof of the affective bond between the litigants, socio-affective paternity is characterized, recognizing it through the principle of affectivity and the best interest of the child and adolescent, despite the existence of a biological bond, because it does not prevail over the affective.
