Resumo: The present monographic work aimed to analyze the reasoning of the courts regarding the positioning of the application of the term determined in the security measures. To do so, use, in terms of level, exploratory research, with the intention of creating familiarity with the object of study. Regarding the approach, a quality is used, as the data collection is based on content extracted from legislation, judgments, theses, doctrines, among other sources. The procedure used to collect data was a bibliographic and documentary research, as the studies were carried out using information and data already published in books, magazines, the written press and publications from several sources already referenced, that is, a data collection took place from indirect form, defined as primary sources. The results obtained by means of the research demonstrated, for the STJ, as security measures must be applied according to the term of the sentence abstractly related to the crime, based on or prism that there is no different treatment between inimitable and semi-inimitable, respecting the principles of isonomy and proportionality and supporting its foundation under a safety measure criterion, follow the rules of the penalty regarding the maximum limit provided for in the legislation, having its own edition already edited. The STF, however, ensures that the security measure is a type of criminal sanction, and that, therefore, it is subject to the rule contained in article 109 of the CP, which determines the maximum term for serving the sentence. In view of the principles presented in the work, as well as the fundamental rights listed in the Federal Constitution of 1988, concluded, although the position is similar, a gap in the legal system is notorious, since the courts use different arguments. Thus, an express term forecast is necessary to standardize the jurisprudence in relation to the subject. Keywords: Criminal law. Penalty. Crime prevention.

Crime prevention.O presente trabalho monográfico teve como objetivo analisar a fundamentação dos tribunais quanto ao posicionamento da aplicação de prazo determinado nas medidas de segurança. Para tanto, empregou-se, quanto ao nível, pesquisa exploratória, intentando criar familiaridade com o objeto de estudo. Com relação à abordagem, utilizou-se a qualitativa, em virtude da coleta de dados ser embasada em conteúdos extraídos da legislação, julgados, teses, doutrinas, entre outras fontes. O procedimento empregado para a coleta de dados foi a pesquisa bibliográfica e documental, pois os estudos foram realizados através de informações e dados já publicados em livros, revistas, imprensa escrita e publicações de diversas fontes já referenciadas, ou seja, a coleta de dados se deu de forma indireta, definida como fontes primárias. Os resultados obtidos por meio da pesquisa demonstraram que, para o STJ, as medidas de segurança devem ser aplicadas de acordo com o prazo da pena abstratamente cominada ao delito, fundamentado sob o prisma de que não haja tratamento diferenciado entre o inimputável e semi-inimputável, respeitando os princípios da isonomia e proporcionalidade e sustentando sua fundamentação sob a égide de que a medida de segurança deva seguir regra da pena quanto o máximo previsto na legislação, havendo súmula própria já editada. O STF, entretanto, assegura que a medida de segurança é um gênero espécie de sanção penal, e que, portanto, submete-se à regra constante no artigo 109 do CP, que estipula prazo máximo de cumprimento da pena. Diante dos princípios apresentados no trabalho, bem como dos direitos fundamentais elencados na Constituição Federal de 1988, conclui-se que, ainda que o posicionamento seja similar, é notória a lacuna existente no ordenamento jurídico, visto os tribunais se utilizassem de argumentos distintos. Desta forma, necessária a previsão expressa do prazo, para uniformizar a jurisprudência com relação ao assunto. Palavras-chave: Direito penal. Pena.
