O termo circunstanciado lavrado pelas polícias militares sob a ótica do ciclo completo de polícia no Brasil: um estudo jurisprudencial

This monograph had as main objective to analyze the Circunstanciado Term elaborated by the Military Police from the perspective of the complete cycle, developing a jurisprudential study. To achieve this objective, a bibliographical and documentary research was developed, working with a line of inductive reasoning and a qualitative approach, promoting an explanatory research with respect to depth. To better understand the subject, we sought to know the powers of the State Police and also what is meant by the administrative police and judicial police terminologies, analyzing what becomes the complete police cycle. Subsequently, the Circumstantial Term was discussed, based on the principles of the Special Criminal Court, presenting the consolidated practice of the Military Police of Santa Catarina, which since 2007, when State Decree No. 660/2007 was plowing the procedure in all its Units. At the end of the study, it was observed that the jurisprudence of the Court of Justice of Santa Catarina has remained favorable to this practice, and the Federal Supreme Court has even manifested itself on the subject recently, not knowing the Direct Action of Unconstitutionality that challenged the Decree. Although the great majority of those judged to be favorable to drafting, there are also decisions to the contrary. Finally, it was observed that the successful experience of drafting the Term Circunstanciado by the Military Police inaugurates the complete cycle in the scope of the Special Criminal Courts, which has shown the competence of the institution and the gains that could be obtained with its extension to the other procedures.
