Resumo: The lack of specific legislation regulating and inspecting closed horizontal condominiums, provides a great opening for irregular constructions, which consequently end up hindering the road system. This work aims to analyze the aspects of the closed horizontal condominium in the face of the right to urban mobility. This study seeks to analyze the impacts caused by condominiums that have their perimeter surrounded by large walls that hinder the access to circulation routes around them, as well as to evaluate the consequences of the lack of federal legislation standardizing and regulating this type of housing, in the way that alleviate urban segregation and explicit division between social classes. The method used for this research was through legislation and review of bibliographic studies, using as references articles published in scientific journals, congresses, books, legislation and jurisprudence on matters of closed horizontal condominium and urban mobility. With the results evaluated, it was possible to verify, based on the evaluated literature, that not all closed horizontal condominiums are harmful to cities, the little ones in extension and with good planning do not harm urban mobility and reduce the impacts generated by the enclosure. It is observed that there is still much to be studied and we suggest new studies in the field of closed horizontal condominium.

O presente trabalho tem por objetivo analisar os aspectos do condomínio horizontal fechado frente ao direito à mobilidade urbana. Este estudo busca analisar os impactos ocasionados por condomínios que possuem seu perímetro cercado por grandes muros, dificultando o acesso às vias de circulação ao seu entorno, bem como avaliar as consequências da falta de legislação federal padronizando e regulamentando esta modalidade de moradia, de forma que amenize a segregação urbana e explicita divisão entre classes sociais. O método usado para essa pesquisa foi através de legislação e revisão de estudos bibliográficos, utilizando como referências artigos publicados em periódicos científicos, congressos, livros e jurisprudências em matéria de condomínio horizontal fechado e mobilidade urbana. Com os resultados obtidos foi possível verificar, com base na literatura avaliada, que nem todos os condomínios horizontais fechados são prejudiciais às cidades. Fico claro que as modalidades de menores extensões e as que possuem um bom planejamento não prejudicam a mobilidade urbana e diminuem os impactos gerados pelo cerceamento.
