Resumo: This essay aims the study of the subjective aspects of the employee in relation to the hierarchic superior in cases of moral harassment. This phenomenon causes a serious consequences in the individual’s life who suffers this kind of violence, it does no matter if it is in the social, professional or personal life. However, employees, in a subjective way, have confused some situations with moral harassment and have engaged lawsuits in order to obtain indemnity, claiming they have suffered such violence. Therefore, for better understanding, researches in doctrines, scientific articles, jurisprudences, monographies and even the Brazilian law were conducted, to be able to perform a deeper analysis of the situation. By this mean, the whole concept of moral harassment was verified, which elements compound this violence and, at the same time, it was possible to understand which are the subjective aspects of the employee and also what is not considered moral harassment. With the study, it was noticed that many employees have mistaken thinking that they have been persecuted and that they have been suffering moral harassment. They confuse common everyday facts and even because they have a mental issue, such as schizophrenia or paranoid, they get to get deluded about something only they see, not having the harassment figure and before this situation, if it is not proofed they are suffering the given violence, the employer will have the right to terminate the work contract by fair cause.

Tal fenômeno provoca sérias consequências na vida do indivíduo que sofre essa violência, seja na vida pessoal, profissional ou social. Entretanto, empregados, de forma subjetiva, têm confundido algumas situações com o assédio moral e têm ingressado com ação a fim de obter indenização alegando ter sofrido a tal violência. Sendo assim, para melhor compreensão, foram realizadas pesquisas em doutrinas, artigos científicos, jurisprudências, monografias, e a própria legislação brasileira, para que fosse possível uma análise mais profunda da situação. Por meio deste trabalho monográfico, verificou-se conceito de assédio moral, quais os elementos que caracterizam essa violência, da mesma forma, compreendem-se quais são os aspectos subjetivos por parte do empregado, e o que não é considerado o assédio moral.
