Resumo: OBJECTIVE: The present monograph aims to analyze the possibility or not of the civil arrest of the minor debtor. METHOD: As for the depth level, the research will be exploratory. Regarding the approach, it will be qualitative in nature. The procedure used for data collection will be the bibliographic as well as the documentary. RESULTS: It was found that, as a rule, the underage parent is responsible for the needs of the child he or she generates, since there is no differentiation in the legislation regarding the underage parent. CONCLUSION: It was concluded that, although there is no prohibition on imprisonment of the incapable person who owes maintenance (emancipated or not), considering that the defaulter is a developing person and, therefore, presumably unable to keep himself or herself financially, as well as in order to respect ECA protections, civil imprisonment of the defaulting feeder is not possible.

MÉTODO: Quanto ao nível de profundidade, a pesquisa será exploratória. No que concerne à abordagem, será de natureza qualitativa. O procedimento utilizado para a coleta de dados será o bibliográfico, além do documental. RESULTADOS: Verificou-se que, em regra, o genitor menor de idade é responsável pelas necessidades do filho que venha a gerar, uma vez que não há, na legislação, diferenciação sobre o genitor maior ou menor de idade.
