Resumo: The present monograph had as general objective to analyze the possibility of the application of chemical castration in those convicted of rape crime in Brazil. To do so, the method of deductive approach was used, starting, initially, a general study about guiding principles of Brazilian criminal law, rape crime in its general notion, chemical castration, as a procedure used in the punishment of convicts by rape crime, and subsequently an analysis on the applicability of chemical castration before the Brazilian legal system, in order to reach a conclusion on the subject. The type of research used was exploratory, with a qualitative approach and bibliographic procedure, based on doctrines, articles, academic research and current legislation. It was possible to conclude that the institute studied presents itself as an unconstitutional means, becoming unacceptable as a penalty in our legal system, and bills in this sense are flagrantly unconstitutional. However, it is understood that nothing prevents the condemned from being offered as a deprivation of the penalty, submission to treatment.

Para tanto, utilizou-se o método de abordagem dedutivo, partindo, inicialmente, de um estudo geral acerca de princípios norteadores do direito penal brasileiro, do crime de estupro em sua noção geral, a castração química, como procedimento utilizado na punição dos condenados por crime de estupro, posteriormente uma análise sobre a aplicabilidade da castração química diante do ordenamento jurídico brasileiro, para, ao final, atingir uma conclusão relativamente ao tema. O tipo de pesquisa empregado foi o exploratório, com abordagem qualitativa e procedimento bibliográfico, baseado em doutrinas, artigos, pesquisas acadêmicas e na legislação vigente. Foi possível concluir que o instituto estudado se apresenta como meio inconstitucional, tornando-se inaceitável como pena em nosso ordenamento jurídico, e os projetos de lei nesse sentido são flagrantemente inconstitucionais.
