Limites e possibilidades da inteligência artificial aplicada ao direito: estado da arte no Brasil

The work aims to analyze the state of the art of applying solutions based on Artificial Intelligence to Law in Brazil. The methodology used was exploratory research, with a qualitative approach. In relation to data collection, this work is classified as bibliographic and documentary, as it use publications in books, laws, scientific articles, theses, dissertations, newspaper articles, etc. A survey was also conducted electronically with 445 legal operators working in the private sector. From the analysis of the data, the existence of relevant possibilities in the public and private sectors was identified, such as the predictive analysis of decisions and the automatic suggestion of draft sentences, in addition to large-scale projects, under development, all in the sense of increasing speed, assertiveness and productivity, in the jurisdictional provision. However, ethical and philosophical limits are also identified, such as the risk of bias in the algorithm, and others with a technical profile, such as the difficulty of auditing systems, requiring some effort to be overcome. The need to establish a legal framework was also identified. Therefore, an environment in high frequency of movement has been established in the Brazilian legal environment, as a result of what brings about the digital transformation, in terms of the possibility of providing people, considered a sociological approach, better conditions of access to information, justice, through a more assertive, quick and cheap judicial provision. Overcoming the limits should only be a matter of time, since the conditions for that seem to be established.
