The present work had the objective to analyze the Law Project nº 258/2016 currently under way in Special Commission of Senate, which aims to update the Brazilian Air Law Code. Our current code, the primary source of aeronautical law “born” at 1986, so, it no longer reflects the yearnings and problems faced by Brazilian aviation.The lack of a current rule not only reflects the development of the sector that is trying to regulate, but also forces the government agencies, to issue several other types of rules, to make up the lack of a updated legislation. The project that is being carried out in Congress is coming to help the air activity in Brazil, but as it is analyzed in the present work, the legislator tries to the maximum to answer the existing demands and imagine the ones that will emerge and ends to promote a series of legis lative confusions .The confusion that caught our attention, was the intention of the legislator to ignore some laws and codes that influence and are sources of aeronautical law, and give the new BAC (Brazilian Air Code) a privileged position in conjunction with the International Conventions. In that way, without using a “crystal Ball”, we can already imagine future dis cussions on conflicts of norms, and wich legislation to apply, as has already occurred in Aeronautical Law and seems to return the discussions.
