This paper aims to identify the limits of the fundamental right of Freedom of Expression in the demonstrations carried out by the Separatist Movement "O Sul é o Meu País", in light of the Federal Constitution of 1988 and the National Security Law (n. 7.170/83). Regarding the methodology used in the development of the present work, an exploratory and qualitative research was carried out. As for the data collection procedure, the bibliographical, the documentary and the case study were used. The results of the present study were that the demonstrations by the Movement, as they are currently carried out, constitute a legitimate exercise of the fundamental right of freedom of expression and even though defying the federative pact, "O Sul é o Meu País" offers no risk to National Security. After conducting the research, it is concluded that the crime foreseen in article 11 of the National Security Law was received in part by the Federal Constitution of 1988, since it does not consider as a normative element of the type the serious threat or violence, which violates freedom of expression and the principle of the dignity of the human being when combined with articles 22, IV and 23, IV of the same Law. Thus, the limits of the fundamental right of freedom of expression in the context of the demonstrations carried out by the Separatist Movement "O Sul é o Meu País" are in the National Security Law itself, as long as that they are analyzed under the prism of the current constitutional text, in order to avoid curtailing the fundamental rights and guarantees.
