Resumo: The theme of this article is based on the role of the tutor in Distance Education (EaD), pervading Decree nº 5622, published in 2005 and which was revoked by Decree 9,057, in 2017. The following problem was investigated: “what are the productions national scientific findings published in the work of the last four ANPED meetings, which disagree regarding the issue of mentoring in its scope and which (do not) mention the decree in force at the time researched, in the period from 2015 to 2021?” The general objective was to analyze the national academic production of articles published in the last four national meetings of ANPED (2015-2021) on tutoring in distance learning that mention Decree No. 5,622/2005 and/or Decree No. 9,057/2017. This was a theoretical qualitative research, of a descriptive and exploratory nature, in which four productions were found to compose the data analysis corpus. The final considerations point to the lack of clarity between the nomenclatures used in relation to the virtual tutor, as well as regarding the role assigned to him, corroborating the statements that there is no defined role in his field of work, as well as gaps in the determination cool about their actual functions.   Keywords: Education. Se investigó el siguiente problema: "¿cuáles son las producciones científicas nacionales publicadas en los trabajos de las últimas cuatro reuniones de la ANPED, que respecto a este decreto que aborda el tema de la tutoría en su ámbito, en el período de 2015 a 2021?" El objetivo general analizar la producción académica nacional de artículos publicados en los últimos cuatro encuentros nacionales de la ANPED (2015-2021) sobre tutoría en educación a distancia mencionados en el Decreto nº 5.622/2005. Este trabajo es relevante para brindar una reflexión crítica sobre el tema elegido y, debido a la pandemia de COVID-19, el aprendizaje a distancia se ha convertido en la nueva normalidad. Fue una investigación cualitativa teórica, de naturaleza descriptiva y exploratoria, en la que se encontraron cuatro producciones para componer el corpus de análisis de datos. Como consideraciones finales señalar que aún no existe claridad entre las nomenclaturas utilizadas, así como, en cuanto a la función destinada al tutor virtual, además de los datos recabados señalando la falta de sustento legal en la legislación laboral.O tema deste artigo está embasado no papel do tutor na Educação à Distância (EaD), perpassando pelo Decreto nº 5622, publicado em 2005 e que foi revogado pelo Decreto 9.057, em 2017. Investigou-se o seguinte problema: “quais são as produções científicas nacionais divulgadas nos trabalhos das últimas quatro reuniões da ANPED, que discorrem a respeito da questão da tutoria em seu escopo e que (não) mencionam o decreto em vigor na época pesquisada, no período compreendido de 2015 a 2021?” O objetivo geral foi analisar a produção acadêmica nacional de artigos publicados nas últimas quatro reuniões nacionais da ANPED (2015-2021) sobre tutoria em EAD que mencionam o Decreto Nº 5.622/2005 e/ou o Decreto Nº 9.057/2017. Tratou-se de uma pesquisa qualitativa teórica, de natureza descritiva e exploratória, em que foram encontradas quatro produções para compor o corpus da análise de dados. As considerações finais apontam para a falta de clareza entre as nomenclaturas utilizadas em relação ao tutor virtual, bem como a respeito da função destinada a ele, corroborando as afirmativas de que não há um papel definido no seu campo de trabalho, bem como lacunas na determinação legal sobre as suas funções reais.   Palavras-chave: Educação.
