Resumo: The essay exposes how Italian Law deals with the mitigation of damage and how it can influence Brazilian law. The problem identified in this research concerns the lack of discipline of victim behavior in Brazilian law. The work will seek to answer how Italian law can contribute to a legislative discipline on the matter. A critical analysis of Italian Law can contribute to a possible change in the Brazilian legal text. The work was divided into five parts. In all of them, the parts provided from art. 1227 of the Italian Civil Code. At first, the notion of concurrent fault is verified in comparison with 945 article of the Brazilian Civil Code. Subsequently, the rule regarding the mitigation of damage, its foundations and characteristics will be verified. The conclusion will address the inconvenience of disciplining the matter in the same article as the concurrent fault. The methodology employed in the work was dogmatic, with the analysis of articles 1227 of the Italian Civil Code and 945 of the Brazilian Civil Code, and doctrinal with the verification of texts that address the discipline in Italian law.

El problema identificado en la investigación se refiere a la falta de disciplina del comportamiento de la víctima en la ley brasileña. El trabajo tratará de responder cómo la legislación italiana puede contribuir a una disciplina legislativa sobre el tema. El análisis crítico de la legislación italiana puede contribuir a la posible alteración del texto jurídico brasileño. La obra se dividió en cinco partes. En total, se analizan las normas establecidas en el artículo 1227 del Código Civil italiano. En un primer momento, la noción de culpabilidad concurrente se verifica en comparación con el artículo 945 del Código Civil brasileño. Posteriormente, se verificará la norma relativa a la mitigación de la lesión, sus fundamentos y características. La conclusión abordará la inconveniencia de disciplinar el asunto en el mismo artículo de culpabilidad concurrente. La metodología empleada en el trabajo fue dogmática, con el análisis de los artículos 1227 del Código Civil italiano y 945 del Código Civil brasileño y doctrinal con la verificación de textos que abordan la disciplina en el derecho italiano.O ensaio expõe como o direito italiano trata a mitigação do prejuízo e como ela pode influenciar o direito brasileiro. O problema identificado na pesquisa diz respeito à ausência de disciplina do comportamento da vítima no direito brasileiro. O trabalho buscará responder de que maneira o direito italiano pode colaborar para uma disciplina legislativa sobre a matéria. A análise crítica do direito italiano pode colaborar para eventual alteração do texto legal brasileiro. O trabalho foi dividido em cinco partes. Em todas, analisam-se as regras previstas no art. 1227 do Código Civil italiano. Em um primeiro momento, é verificada a noção de culpa concorrente em comparação com o art. 945 do Código Civil brasileiro. Posteriormente, será verificada a regra referente à mitigação do prejuízo, seus fundamentos e características. A conclusão abordará a inconveniência de disciplinar a matéria no mesmo artigo da culpa concorrente.
