Italian Legislative Decree No. 101/2018: an analysis of the comparative experience on the implementation of the GDPR

Resumo: The creation of regulatory frameworks specifically aimed at safeguarding the gathering, processing and storage of personal data is an inexorable trend and, in 2018, the General Data Protection Regulation (GDPR) on the European continent, as well as promulgation of the Brazilian Data Protection Law, were important events. In Italy, which has long been trying to regulate the protection of personal data, this exercise came with the advent of the newest amendment to the Codice della Privacy (Legislative Decree No. 196/2003) of that country: Legislative Decree No. 101, of August 10 of 2018, which entered into force on September 19, 2018. Starting from the problematization related to the difficulty of realizing the fundamental right to data protection, the present study works with analysis of the comparative experience in the effort to extract substrates that lead to this purpose. The hypothesis is based on the identification, in the foreign source, of comparative substrates for dealing with the problem-theme, in particular regarding the identification of inspiring compatibilities, from which Brazilian legislation could benefit. Among several items, eight were selected for further analysis. Methodologically, the study works with a theoretical, exploratory and comparative approach. In conclusion, it appears that the potential solutions that might be incorporated into the national legal system in order to reach the desired normative amplitude can, in fact, be obtained from comparative exploration.

En Italia, donde la protección de datos personales había sido probada durante mucho tiempo, este ejercicio tuvo lugar con el advenimiento de la reforma más reciente al Codice della Privacy (Decreto Legislativo No. 196/2003) por el Decreto Legislativo No. 101, de 10 de agosto de 2018, que entró en vigencia el 19 de septiembre de 2018. A partir de la problematización relacionada con la dificultad de realizar el derecho fundamental a la protección de datos, este estudio trabaja con un análisis de la experiencia comparativa en el afán por extraer sustratos que conducen a este desiderátum. La hipótesis se basa en la identificación, en la fuente extranjera, de sustratos comparativos para abordar el tema-problema, en particular en lo que respecta a la identificación de compatibilidades inspiradoras, de las cuales la legislación brasileña podría beneficiarse. Entre varios elementos, se seleccionaron ocho para un análisis más detallado. Trabaja, en términos metodológicos, con un enfoque teórico, exploratorio y comparativo. En conclusión, parece que las posibles soluciones que pueden incorporarse al ordenamiento nacional para alcanzar la amplitud normativa deseada pueden, de hecho, obtenerse de la exploración comparativa.A criação de marcos regulatórios especificamente voltados à tutela da coleta, do tratamento e da armazenagem de dados pessoais é uma tendência inexorável e, no ano de 2018, observou-se o implemento do Regulamento Geral de Proteção de Dados (RGPD) no continente europeu, além da promulgação da Lei Geral de Proteção de Dados brasileira. Na Itália, onde há muito já se tentava regular a proteção de dados pessoais, este exercício se deu com o advento da mais nova reforma ao Codice della Privacy (Decreto Legislativo nº 196/2003) daquele país: o Decreto Legislativo nº 101, de 10 agosto de 2018, que entrou em vigor em 19 de setembro de 2018.  Partindo da problematização relativa à dificuldade de concretização do direito fundamental à proteção de dados, o presente estudo trabalha com análise da experiência comparada no afã de extrair substratos que conduzam a esse desiderato. A hipótese parte da identificação, na fonte estrangeira, de substratos comparativos para enfrentamento do tema-problema, em especial quanto à identificação de compatibilidades inspiradoras, das quais a legislação brasileira poderia se beneficiar. Dentre vários itens, foram selecionados oito para análise mais detida. Trabalha-se, em termos metodológicos, com abordagem teórica, exploratória e comparativa.
