O Closing borders in pandemic times in the light of fraternal right

Resumo: The pandemic established in the world obliges humanity to rethink concepts that have been consolidated until then. Morals and ethics come into combat, economy in a state of alert, health in calamity, while the world watches an abstract phenomenon turn into an invisible wave, but with concrete effects beyond its own physical boundaries: globalization, which facilitates, through access to information, and makes it difficult, with the spread of a dangerous disease at the same time. There are several questions, but this article specifically asks: there is a need for a paradigm shift accelerated by the health crisis that affects all of humanity, in particular, about the measure adopted by some countries to close borders in the light of Eligio Resta's thoughts? The hypothesis found is that, for a better adaptation of changes, Fraternal Law and international cooperation are fundamental in the restructuring of global actions to combat pandemics. The questioning is justified by the urgency of the current moment, given the extremely high contagion of the virus, which does not choose standards. For the research, the deductive method developed through documentary research and data from international organizations, news and literature review was used, especially from the theoretical framework already mentioned by Eligio Resta. The first chapter discusses how the restrictions on movement in the South American countries, especially those bordering Brazil, took place. In a second step, we explored the Law of Friendship and the way this metatoria influences the relativization of sovereignty. On a continuous basis, we analyze the application of fraternity on the borders in a pandemic situation. In this sense, better than closing the borders to contain the virus, it would have been the opening of dialogue between all countries, prioritizing the universality of fundamental rights, as recommended by the fraternal code.

La moral y la ética entran en combate, la economía en estado de alerta, la salud en la calamidad, mientras el mundo mira cómo un fenómeno abstracto se convierte en una ola invisible, pero con efectos concretos más allá de sus propios límites físicos: la globalización, que facilita, el acceso a la información, y lo dificulta, con la propagación de una enfermedad peligrosa al mismo tiempo. Son varias las interrogantes, pero este artículo se pregunta específicamente: hace falta un cambio de paradigma acelerado por la crisis de salud que afecta a toda la humanidad, en particular, sobre la medida adoptada por algunos países de cerrar fronteras a la luz del pensamiento de Eligio Resta? La hipótesis encontrada es que, para una mejor adaptación de los cambios, el Derecho Fraternal y la cooperación internacional son fundamentales en la reestructuración de las acciones globales para combatir las pandemias. El cuestionamiento se justifica por la urgencia del momento actual, dado el altísimo contagio del virus, que no elige estándares. Para la investigación se utilizó el método deductivo desarrollado a través de la investigación documental y datos de organismos internacionales, revisión de noticias y literatura, especialmente del marco teórico ya mencionado por Eligio Resta. El primer capítulo analiza cómo se produjeron las restricciones a la circulación en los países sudamericanos, especialmente en los limítrofes con Brasil. En un segundo paso, exploramos la Ley de la Amistad y la forma en que esta metatoria influye en la relativización de la soberanía. De forma continua, analizamos la aplicación de la fraternidad en las fronteras en situación de pandemia. En este sentido, mejor que cerrar las fronteras para contener el virus, hubiera sido la apertura del diálogo entre todos los países, priorizando la universalidad de los derechos fundamentales, como recomienda el código fraterno.A pandemia instaurada no mundo obriga a humanidade a repensar sobre os conceitos até então consolidados. Moral e ética entram em combate, economia em estado de alerta, saúde em calamidade, enquanto o mundo observa um fenômeno abstrato transformar-se numa onda invisível, porém com efeitos concretos além das próprias fronteiras físicas: a globalização, que facilita, por intermédio do acesso às informações, e dificulta, com a disseminação de uma doença perigosa ao mesmo tempo. Diversos são os questionamentos, mas este artigo indaga, especificamente: existe uma necessidade de mudança de paradigmas acelerada pela crise sanitária que afeta toda a humanidade, em especial, acerca da medida adotada por alguns países de fechamento de fronteiras à luz dos pensamentos de Eligio Resta? A hipótese encontrada é a de que, para uma melhor adaptação das mudanças, o Direito Fraterno e a cooperação internacional são fundamentais na reestruturação de ações mundiais de combate às pandemias. O questionamento se justifica pela urgência do momento atual, dado o altíssimo contágio do vírus, que não escolhe padrões. Para a pesquisa foi utilizado o método dedutivo desenvolvido por meio de pesquisa documental e em dados de organizações internacionais, notícias e revisão de literatura em especial do referencial teórico já mencionado de Eligio Resta. O primeiro capítulo aborda como se deram as restrições de circulação nos países sul-americanos, em especial aos fronteiriços com o Brasil. Em um segundo momento, exploramos a Lei da Amizade e a forma como esta metatoria influencia na relativização da soberania. Ato contínuo, analisamos a aplicação da fraternidade nas fronteiras na situação de pandemia.
