The responsibility of the state and of the private initiative in the promotion of healthy work environment within a risk society: reflections about SAT and FAP as incentive mechanisms towards the principles of prevention and precaution

Resumo: The goal of the present study is a reflection about the position of State and the private initiative towards the increscent demand for prevention and precaution in the matter of the Health and Safety at Work, with notes regarding legislative instruments created as incentives to a healthier work environment. There will be, at start, based on the notes of Beck and Luhmann, considerations about professional risks in risk society and the importance of the Environmental Law’s principles of precaution and prevention, approached by Ingo Sarlet and Tiago Fensterseifer, in the debates concerning Health and Safety at Work. Brief comments will be rendered about the State’s role as responsible for the protection of workers, as a direct protector as much as encouraging employers to value safer work environments. It will be shown, however, that state’s mechanisms such as SAT and FAP stumble by overtaxing employers, through the inclusion of misfortunes that are unrelated to the work environment in the concept of work accident. This, according to the critics of Floriani Neto, transfers to the private initiative the responsibility of the Government’s inefficiency in social protection, jeopardizing a more effective spur to those who guarantee safer work place, disregarding, thus, the principle of solidarity.

Inicialmente, desde las ideas de Beck y Luhmann, se harán consideraciones sobre los riesgos profesionales en la sociedad del riesgo y sobre la importancia de los principios de derecho ambiental de precaución y prevención, abordados por Ingo Sarlet e Tiago Fensterseifer, en las discusiones sobre Seguridad y Salud del Trabajo . Serán elaborados breves comentarios sobre el papel del Estado como responsable de la protección de los trabajadores, tanto como protector directo cuanto mediante la función de incentivar la iniciativa privada a predicar por ambientes de trabajo más seguros. Se evidenciará, sin embargo, que los mecanismos estatales que se encargan de esa finalidad, como SAT y FAP, equivocanse en onerar los empleadores, por insertar en el concepto de accidente de trabajo infortunios ajenos al ambiente laborativo. Esto, según la crítica de Floriani Neto, transfiere a la iniciativa privada la responsabilidad por la ineficiencia del Estado en la protección social, perjudicando un incentivo más concreto a quien asegura ambientes laborales más seguros, hiriendo así el principio de la solidaridad.O presente estudo é uma reflexão acerca da posição do Estado e da iniciativa privada perante a crescente demanda por prevenção e precaução em Segurança e Saúde do Trabalho, com apontamentos sobre os instrumentos legislativos criados como incentivo a um ambiente de trabalho mais sadio. Ao início, com fulcro nos apontamentos de Beck e Luhmann, serão feitas considerações sobre os riscos profissionais na sociedade de risco e sobre a importância dos princípios de direito ambiental de precaução e prevenção, abordados por Ingo Sarlet e Tiago Fensterseifer, nas discussões sobre Segurança e Saúde do Trabalho. Serão tecidos breves comentários sobre o papel do Estado como responsável pela proteção dos trabalhadores, tanto como protetor direto quanto na função de incentivar a iniciativa privada a prezar por ambientes de trabalho mais seguros. Evidenciar-se-á, contudo, que os mecanismos estatais para estes fins, como SAT e FAP, pecam ao onerar os empregadores, incluindo no conceito de acidente de trabalho infortúnios alheios ao ambiente laborativo.
