Resumo: O presente trabalho faz uma análise da incidência da súmula 289, editada pelo Superior Tribunal de Justiça. Esta súmula versa acerca da correção monetária dos valores vertidos aos planos de benefícios das Entidades de Previdência Complementar pelos participantes que fazem o resgate das contribuições, determinando que o índice a ser utilizado deverá ser o que melhor reflete a inflação. Considerando que a previdência complementar se ramifica no âmbito aberto e fechado, verificar-se-á a constitucionalidade da súmula editada pelo Superior Tribunal de Justiça em relação às Entidades Fechadas. Para tanto, pautar-se-á na natureza das Entidades Fechadas de Previdência Complementar, bem como na conseqüência da aplicação da referida súmula.

The subject of the summa is about the monetary correction of the values delivered to the complementary pension plans by the participants who ask their money back, ordering that the index of correction should be the one which reflex better the inflation. Considering that the complementary pension plan can be opened and closed, it is going to check the constitutionality of the summa edited by the Federal Superior Court of Brazil.
