STRUCTURAL VIOLATIONS IN THE INTER-AMERICAN HUMAN RIGHTS SYSTEM: AN ANALYSIS BASED ON THE CASE FAVELA NOVA BRASÍLIA VS. BRAZIL

Resumo: | Objetivo: The main objective of this work is to understand whether the Brazilian conviction by the Inter-American Court of Human Rights (IDH Court), in the case of Favela Nova Brasília vs. Brazil, caused material and symbolic effects capable of helping to face a structural litigation caused by the malfunction of the public security system in the state of Rio de Janeiro.Methodology: The deductive method and bibliographic-documentary research are adopted, with a qualitative approach.Results: Despite the importance of the Inter-American Human Rights System, the almost complete failure to comply with the penalties presented in the decision that condemns Brazil for the atrocities committed in the case in question, demonstrates the country's disregard for the realization of human rights, as well as an evident violation of international obligations. It is also worth noting, in this sense, that none of the three measures fully adopted by Brazil, aimed at overcoming the problem related to the public security system in the state of Rio de Janeiro, has a structural character. Given this scenario, it is clear that, so far, the sentence has not caused the intended material or symbolic effects.Contributions: The Brazilian conviction in the case of Favela Nova Brasília v. Brazil, despite not having produced all the conjectured results, it had an unexpected material effect: it served as a driving force for the proposal of ADPF 635, known as “ADPF das Favelas”. The aforementioned action proved to be an important instrument to face the nefarious violations of human and fundamental rights caused by the public security policy of the state of Rio de Janeiro, as well as a landmark in terms of the empowerment of victims, who saw in the STF a forum of political deliberation and a locus in which their demands could be met. Still in this sense, the Action directly addresses the fact that police violence affects, above all, the black population that inhabits the favelas, an important aspect in the fight against structural racism. This reality reinforces the capacity of the Inter-American Human Rights System to cause transformative impacts, as well as highlights the relevance of the work carried out by the Inter-American Court of Human Rights, especially in scenarios of extreme inequality, exclusion and violence such as the Brazilian one. |

También vale la pena señalar, en este sentido, que ninguna de las tres medidas adoptadas en su totalidad por Brasil, destinadas a superar el problema relacionado con el sistema de seguridad pública en el estado de Río de Janeiro, tiene un carácter estructural. Ante este escenario, es claro que, hasta el momento, la sentencia no ha causado los efectos materiales ni simbólicos pretendidos.Contribuciones: La condena brasileña en el caso de Favela Nova Brasilia v. Brasil, a pesar de no haber producido todos los resultados conjeturados, tuvo un efecto material inesperado: sirvió de impulsor de la propuesta de la ADPF 635, conocida como “ADPF das Favelas”. La referida acción resultó ser un importante instrumento para enfrentar las nefastas violaciones a los derechos humanos y fundamentales provocadas por la política de seguridad pública del estado de Río de Janeiro, así como un hito en lo que se refiere al empoderamiento de las víctimas, que vieron en la STF un foro de deliberación política y un lugar en el que sus demandas podrían ser atendidas. También en este sentido, la Acción aborda directamente el hecho de que la violencia policial afecta, sobre todo, a la población negra que habita en las favelas, aspecto importante en la lucha contra el racismo estructural. Esta realidad refuerza la capacidad del Sistema Interamericano de Derechos Humanos para generar impactos transformadores, así como destaca la relevancia del trabajo que realiza la Corte Interamericana de Derechos Humanos, especialmente en escenarios de extrema desigualdad, exclusión y violencia como como el brasileño.Objetivos: O presente trabalho tem como objetivo central compreender se a condenação brasileira pela Corte Interamericana de Direitos Humanos (Corte IDH), no caso Favela Nova Brasília vs. Brasil, provocou efeitos materiais e simbólicos capazes de auxiliar no enfrentamento de um litígio estrutural provocado pelo mau funcionamento do sistema de segurança pública no estado do Rio de Janeiro.Metodologia: Adota-se o método dedutivo e pesquisa de cunho bibliográfico-documental, com abordagem qualitativa.Resultados: Não obstante a importância do Sistema Interamericano de Direitos Humanos, o descumprimento quase que integral das penalidades apresentadas na decisão que condena o Brasil pelas atrocidades cometidas no caso em questão demonstra o descaso do país com a efetivação dos direitos humanos, bem como uma evidente violação de obrigações internacionais. Destaca-se, ainda nesse sentido, que nenhuma das três medidas integralmente adotadas pelo Brasil, visando à superação do problema relativo ao sistema de segurança pública do estado do Rio de Janeiro, têm caráter estrutural. Diante desse cenário, vislumbra-se que, até o presente momento, a sentença não provocou os efeitos materiais ou simbólicos pretendidos.Contribuições: A condenação brasileira no caso Favela Nova Brasília vs. Brasil, apesar de não ter surtido todos os resultados objetivados, teve um efeito material inesperado: serviu como força motriz para a propositura da ADPF 635, conhecida como “ADPF das Favelas”. A referida Ação mostrou-se um importante instrumento de enfrentamento às nefastas violações a direitos humanos e fundamentais provocadas pela política de segurança pública do estado do Rio de Janeiro, bem como um marco no que concerne ao empoderamento das vítimas, que enxergaram no STF um foro de deliberação política e um locus no qual suas demandas poderiam ser atendidas. Ainda nesse sentido, a Ação aborda diretamente o fato de que a violência policial atinge, sobretudo, a população preta que habita as favelas, aspecto importante na luta contra o racismo estrutural.
