THE CENTRALITY OF ETHICAL-ANTHROPOLOGICAL FOUNDATIONS IN THE CASE OF ABORTION: A DEFENSE OF REALISTIC PERSONALISM

Resumo: Objective: This article deals with the centrality of ethical-anthropological foundations in the case of abortion. Specifically, its aim is (1) to expose, descriptively, the three pro-abortion perspectives that stand out today based on different ethical‑anthropological foundations: the functionalist pro-abortion perspective, the libertarian pro-abortion perspective and the relational pro-abortion perspective; (2) to expose the misconceptions that underlies the ethical‑anthropological foundations of such perspectives; and (3) to demonstrate that the very exposition of the fundamental mistakes of the most famous contemporary pro‑abortion perspectives is supported by a specific ethical‑anthropological foundation called realistic  personalism, according to which each and every human being is a type of being marked by an intrinsic dignity from his biological origin until his death, and, therefore, holder of duties and rights that precedes state positivization.Method: Theoretical and reflective approach according to authorized and updated bibliography. In addition to paying attention to current embryological and genetic data that point to conception as the original biological moment of a new human being, it uses the lessons of Thomas Aquinas and his contemporary interpreters, with emphasis on those that constitute the New School of Natural Law.Results: The main current pro-abortion perspectives emphasize a single aspect of the person, reducing the other aspects to the one that is emphasized. On the contrary, realistic personalism proposes an integral vision of man's personality, declaring it ontologically, axiologically, biologically and legally without denying the possibility of knowing and observing humanity from inexhaustible angles. In the context of abortion, realistic personalism, by rational demand, denounces its common mistake, understanding that the abortive practice is usually a direct affront to the absolute moral right that the unborn child – a worthy human person – has not to be killed by someone else since the moment he is conceived.Contribuitions: This article contains preliminary notes, however technical. Its contribuition goes back to the necessary advancement of studies attentive to self-evident ends or purposes (basic goods) that concern the personal fulfillment of human beings. More – due to gaps in the national literature at the philosophical-legal and bio-legal level, its contribution also goes back to the urgency of providing scholars with a holistic view of the ethical-anthropological foundations common today in the case of abortion. It should also be added that this article enables an in-depth study of the ethical-anthropological foundations exposed therein. It is understood, however, that the constitutive foundations of the functionalist, libertarian and relational pro-abortion perspectives are in line with a self-destructive mentality expressed, for example, in slavery, racism, the marginalization of women, contempt for the elderly and ridicule of human beings with disabilities.

Específicamente, se pretende (1) exponer descriptivamente las tres perspectivas abortistas que se destacan en la actualidad a partir de diversos fundamentos ético‑antropológicos: la perspectiva abortista funcionalista, la perspectiva abortista libertaria y la perspectiva abortista relacional; (2)  exponer los errores que orientan los fundamentos ético‑antropológicos de tales perspectivas; y (3) demostrar que la exposición de los errores fundamentales de las más famosas perspectivas abortistas contemporáneas se sustenta en un fundamento ético antropológico específico llamado personalismo realista, según la cual todo ser humano es una especie de ser marcado por una dignidad intrínseca desde su origen biológico hasta su muerte, sustentado  así en la titularidad de deberes y  derechos que anteceden a la positividad estatal.Método: Aproximación teórica y reflexiva según bibliografía autorizada y actualizada. Además de prestar atención a los datos embriológicos y genéticos actuales que apuntan a la concepción como el momento biológico originario de un nuevo ser humano, utiliza las enseñanzas de Tomás de Aquino y sus intérpretes contemporáneos, con énfasis en quienes constituyen la Nueva Escuela de la Ley Natural. Resultado: Las principales perspectivas abortistas actuales enfatizan un solo aspecto de la persona, reduciendo los demás aspectos al que se enfatiza. Por el contrario, el personalismo realista propone una visión integral de la personalidad del hombre, declarándo la ontológica, axiológica, biológica y jurídicamente sin negar la posibilidad de conocer y observar a la humanidad desde ángulos inagotables. En el contexto del acto del aborto, el personalismo realista, por exigencia racional, denuncia su común error, entendiendo que la práctica abortiva suele ser una afrenta directa al derecho moral absoluto que tiene el nonato – persona humana digna – de no ser muerto por otro desde su concepción.Contribuciones: Este artículo reúne notas técnicas preliminares. Su aporte se remonta al necesario avance de los estudios atentos a los fines o propósitos evidentes (bienes básicos) que conciernen a la realización personal del ser humano. Y más. Debido a los vacíos en la literatura nacional a nivel filosófico-jurídico y biojurídico, este aporte se remonta también a la urgencia de brindar a los estudiosos una visión holística de los fundamentos ético-antropológicos comunes hoy en día en el caso del aborto. También se piensa que este artículo posibilita un estudio en profundidad de los fundamentos ético-antropológicos allí expuestos. Cabe señalar, sin embargo, que los fundamentos constitutivos de las perspectivas funcionalistas, libertarias y relacionales abortistas están en consonancia con una mentalidad autodestructiva expresada, por ejemplo, en la esclavitud, el racismo, la marginación de la mujer, el desprecio por los ancianos. y ridiculizar a los seres humanos humanos con discapacidades.Objetivo: Trata-se neste artigo da centralidade dos fundamentos ético-antropológicos no caso do aborto. Em específico, visa­‑se a (1) expor, descritivamente, as três perspectivas pró‑aborto que se destacam na atualidade a partir de fundamentos ético‑antropológicos diversos: a perspectiva pró-aborto funcionalista, a perspectiva  pró-aborto libertária e a perspectiva pró‑aborto relacional; (2) expor os equívocos que norteiam os fundamentos ético‑antropológicos de tais perspectivas; e (3) demonstrar que a própria exposição dos equívocos fundamentais das mais famosas perspectivas pró-aborto contemporâneas está subsidiada por um fundamento ético‑antropológico específico denominado personalismo realista, aquele segundo o qual todo e qualquer ser humano é um tipo de ser marcado por uma dignidade intrínseca desde a sua origem biológica até a sua morte, estando, com isso, amparado pela titularidade de deveres e direitos que antecedem positivação estatal.Método: Abordagem teórica e reflexiva segundo bibliografia autorizada e atualizada. Além de atenção aos dados embriológicos e genéticos vigentes que apontam para a concepção como o momento biológico originário de um novo ser humano, utiliza-se das lições de Tomás de Aquino e de seus intérpretes contemporâneos, com destaque para aqueles que constituem a Nova Escola da Lei Natural.Resultado: As principais perspectivas pró-aborto da atualidade enfatizam um único aspecto da pessoa, reduzindo os demais aspectos àquele que é enfatizado. Em sentido contrário, o personalismo realista propõe uma visão integral da personalidade do homem, declarando-a ontológica, axiológica, biológica e juridicamente sem negar a possibilidade de se conhecer e de se observar a humanidade sob inesgotáveis ângulos. No contexto do ato do aborto, o personalismo realista, por exigência racional e não por capricho, denuncia o seu comum equívoco, entendendo que a prática abortiva costuma ser uma afronta direta ao direito moral absoluto que o nascituro – pessoa humana digna – possui de não ser morto por outrem desde a sua concepção.Contribuições: As linhas a seguir reúnem anotações preliminares, inobstante técnicas. Sua contribuição remonta ao necessário avanço de estudos atentos a fins ou a propósitos autoevidentes (bens básicos) que dizem respeito à realização pessoal dos seres humanos. E mais. Devido às lacunas da literatura nacional a nível filosófico-jurídico e biojurídico, tal contribuição remonta também à urgência de se proporcionar aos estudiosos uma visão holística dos fundamentos ético-antropológicos comuns hoje no caso do aborto. Pensa-se, ainda, que este artigo possibilita um estudo aprofundado dos fundamentos ético-antropológicos nele expostos.
