THE JUDICIALIZATION OF STRUCTURAL INJUNCTIONS AS A STRATEGY FOR POLITICAL MOBILIZATION: SOCIAL CHANGES FROM“BOTTOM-TOP” OR “TOP-BOTTOM”?

Resumo: | Objective: This article studies how the protection of socioeconomic and cultural rights (ESC rights) by national courts, in the Global South, can work from a counter-intuitive logic and foster social inequalities. In Brazil, it was observed the problem of individuals with more privileged economic and financial situation and aware of their citizenship are more benefited by the justiciability of ESC rights, to the detriment of socially vulnerable groups.Methodology: The research analyzes the problem of the ineffectiveness of these rights using the deductive method and bibliographic and documental research, investigating how the structural injunctions can be a strategy of political mobilization to trigger social transformations. Thus, the objective is to advance the debate on the roles that organized civil society, as well as the Constituted Powers, can play in an attempt to overcome systemic failures that involve massive and repeated violations of fundamental rights. In this context, it is discussed how social changes can occur, “from the bottom up” or “from the top down”. For this purpose, David Landau's ESC rights protection models were evaluated, as well as the effects of structural sentences and the impacts of affirmative and transformative measures.Results: In the end, it was concluded that the judicialization of structural demands involving the need for adjustment, design or implementation of a public policy, can work as an alternative means to the protection that has been offered to ESC rights by the courts, provided that judges use dialogical procedural tools , rather than prolate self-referenced atomized decisions. Thus, the struggle for social changes must occur, necessarily, through the coordination of efforts between judges, majority bodies and organized civil society.Contribuitions: It introduces structural processes as an alternative form to the atomized protection of social, economic and cultural rights, as well as pointing out the importance of dialogue and cooperation so that effective social changes can take place. |

En Brasil, se observó el problema de que las personas con una situación económica y financiera más privilegiada y conscientes de su ciudadanía se benefician más de la justiciabilidad de DESC, en detrimento de los grupos socialmente vulnerables.Metodología: La investigación analiza el problema de la ineficacia de estos derechos desde el método deductivo e investigación bibliográfico-documental, investigando cómo el proceso estructural puede ser una estrategia de movilización política para desencadenar transformaciones sociales. El objetivo es, por lo tanto, avanzar en el debate sobre los roles que la sociedad civil organizada, así como los Poderes Establecidos, pueden jugar en un intento por superar fallas sistémicas que involucran violaciones masivas y reiteradas de los derechos fundamentales. En este contexto, se discute cómo pueden ocurrir los cambios sociales, “de abajo hacia arriba” o “de arriba hacia abajo”. Para ello, se evaluaron los modelos de protección DESC de David Landau, así como los efectos derivados de las sentencias estructurales y los impactos de las medidas afirmativas y transformadoras.Resultados: Al final, se concluyó que la judicialización de demandas estructurales que involucren la necesidad de ajuste, diseño o implementación de una política pública, puede funcionar como un medio alternativo a la protección que le han brindado los tribunales a DESC, siempre que los jueces utilicen herramientas procedimentales dialógicas, en lugar de entregar decisiones atomizadas autorreferenciadas. Así, la lucha por las transformaciones sociales debe necesariamente darse a través de la articulación de esfuerzos entre jueces, instancias mayoritarias y sociedad civil organizada.Contribuciones: Introduce procesos estructurales como una forma alternativa a la protección atomizada de los derechos sociales, económicos y culturales, además de señalar la importancia del diálogo y la cooperación para que se produzcan cambios sociales efectivos.Objetivo: O presente artigo estuda como a proteção dos Direitos Socioeconômicos e Culturais (DESC) pelas cortes nacionais, no Sul Global, pode funcionar a partir de uma lógica contra-intuitiva e fomentar desigualdades sociais. No Brasil, foi observado o problema de os indivíduos com situação econômico-financeira mais privilegiada e cientes de sua cidadania serem mais beneficiados com a justiciabilidade dos DESC, em detrimento dos grupos socialmente vulneráveis. Metodologia: O artigo analisa o problema da inefetividade desses direitos a partir do método dedutivo e de pesquisa bibliográfico-documental, investigando como o processo estrutural pode ser uma estratégia de mobilização política para desencadear transformações sociais. Objetiva-se, assim, avançar no debate sobre os papéis que a sociedade civil organizada, bem como os Poderes Constituídos, podem desempenhar na tentativa de superação de falhas sistêmicas que envolvem violações massivas e reiteradas a direitos fundamentais. Nesse contexto, é discutido como mudanças sociais podem ocorrer, “de baixo para cima” ou “de cima para baixo”. Para essa finalidade, foram avaliados os modelos de proteção dos DESC de David Landau, bem como os efeitos provenientes das sentenças estruturais e os impactos das medidas afirmativas e transformativas.Resultados: Ao final, concluiu-se que a judicialização de demandas estruturais a envolver a necessidade de ajuste, desenho ou implementação de uma política pública pode funcionar enquanto meio alternativo à proteção que vem sendo oferecida aos DESC pelos tribunais, desde que juízes utilizem ferramentas processuais dialógicas, ao invés da prolatar decisões atomizadas autorreferenciadas.
