The Right to Health of Persons with Disabilities and the Promotional Role of The Healths Protection Center of the Public Defender's Office in the State of Ceará

Resumo: The article aims to analysis the performance of Healths Protection Center of the Public Defender's Office in the State of Ceará in the years 2013 and 2014, notably with regard to the protection of rights of persons with disabilities. This is a specialized service in the demands of health, whose performance has been excelling in the protection of the right to health of the hypossufficient. Judicialization of public policy as an instrument of implementation of the fundamental  right  to  health  is  a  topic  widely  discussed  at  the  Academy  who  makes increasingly practical importance, due to its impact on reality and the involvement of various social actors, with different ideas and interests. This article intended to talk regarding the right to health of persons with disabilities, approaching the challenges to be overcome for their effectiveness and evoking questions about social inclusion. For the understanding of the object, the study used bibliographical research and documentary, with use of theoretical references of documents kept in files of public institution and statistical data elaborated by specialized institutes. In order to obtain detailed information and reports from experience, the study used too an interview with interactive and unstructured nature and exploratory bias. In the end, it was concluded that the performance of the Healths Protection Center has excelled in the awareness of the rights and in the solution of the request by means of health benefits, judicial or outside a court. However, it is necessary that there should be greater dialogue between public authorities, institutions and society, to empower the citizenship of persons with disabilities.

Trata-se de um polo de atendimento especializado nas demandas de saúde, cuja atuação vem se destacando na proteção do direito à saúde dos hipossuficientes. A judicialização das políticas públicas como instrumento de efetivação do direito fundamental à saúde é um tema amplamente discutido na academia que ganha cada vez mais importância prática, devido a sua repercussão na realidade e o envolvimento de diversos atores sociais, com diferentes concepções e interesses. Neste artigo, pretendeu-se discorrer sobre o direito à saúde das pessoas com deficiência, abordando os desafios a serem transpostos para sua efetivação e suscitando questionamentos sobre inclusão social. Para a compreensão do objeto de estudo, utilizou-se pesquisa bibliográfica e documental, com uso de referências teóricas, de documentos conservados em arquivos de instituição pública e de dados estatísticos elaborados por institutos especializados. A fim de obter informações detalhadas e relatos de experiência, realizou-se uma entrevista de natureza interativa e não-estruturada, com viés exploratório. Ao final, concluiu-se que a atuação do Núcleo de Defesa da Saúde tem se destacado desde a conscientização dos direitos até a solução dos pedidos por meio de prestações de saúde, seja judicial ou extrajudicialmente.
