Resumo: This article is scope to analyze the theme of Ronald Dworkin (2007) on the right to integrity in the arrangement within the jurisdiction of the Superior Court of Justice to decide the desaposentação. Therefore, it will be done in analyzing the legality or not of desaposentação is based on the judgment of the Special Appeal n ° .1334488-SC, taking into check the possible legal and doctrinal alternatives to a final agreement. The agenda is theoretical in law as an interpretive concept, ie a set of social practices that must be interpreted (DWORKIN,2007). Methodologically show up conventionality of failures, criticisms of pragmatism and law as integrity theory as applied to difficult cases. Aims to discuss whether there was a limit to the application of the law philosopher proposal and, therefore, if ever there is only one right answer, or there may be situations where there will be several possible answers, even when using the theory of law as integrity.

Para tanto, ele será feito na análise da legalidade ou não da desaposentação se tendo por base o julgamento do Recurso Especial n°.1334488-SC, levando em  cheque  as  possíveis  alternativas  jurídico-doutrinárias  para  a  decisão  do  caso.  O referencial teórico pauta-se no Direito como um conceito interpretativo, ou seja, um conjunto de praticas sociais que devem ser interpretadas (DWORKIN, 2007). Metodologicamente demonstram-se as falhas do convencionalismo, criticas ao pragmatismo e o direito como integridade como teoria aplicável a casos difíceis.
