Resumo: It is discussed the institutional violence in the paradigm of modernity or postmodernity, and how to overcome it through the justiciability of human rights. From the standpoint of Karl-Otto Apel's comprehensive theory of institutions (2000), one seeks to understand how cultural fragmentation and the gradual loss of legitimacy of state bodies and organized civil society contribute to the rapid growth of institutional violence, Reproducing abuses and prejudices embedded in its natural functioning, challenging the Aristotelian ideal of living well, for and with others, in just institutions.
