Resumo: This work aims at analyzing the threat to democracy, especially as a result of the loss of fundamental social rights, achieved with a wealth of struggles and arduous achievements, under the fragile argument of a state in crisis, analyzing the exit of a social state and guarantor for A minimum State, and thus elaborating a contrast with the Principle of Prohibition of Retraction. We used bibliographical and documentary research.
