Carbon Market and the (In)Definition of the Legal Nature of Carbon Credits in Brazilian Legislation

Resumo: In the current circumstances, in which unmeasured human actions are the main reason for the deterioration of the environment, the Kyoto Protocol, through measures such as the Clean Development Mechanism, proposes new prospects for the development of new projects and sustainable technologies. Based on the hypothetical-deductive method, this study presents an alternative as carbon credits, so that you can achieve the goals of reducing emissions of greenhouse gases, the specific object of this study are the Clean Development Mechanism (CDM) that can be used by developing countries. This paper aims to demonstrate that in Brazil, there is still uncertainty about the regulatory standards that establish the legal nature of such claims, which ultimately preventing the proper legal treatment under this kind of trade. Such indefinition is nocuous to the development of the Brazilian carbon market, considering that creates uncertainty for investors.

Such indefinition is nocuous to the development of the Brazilian carbon market, considering that creates uncertainty for investors.No contexto atual, em que as ações humanas descomedidas são as principais razões da deterioração  do  meio  ambiente,  o  Protocolo  de  Kyoto,  através  de  medidas  como  o Mecanismo  de  Desenvolvimento  Limpo  (MDL),  propõe  novas  perspectivas  para  o desenvolvimento de novos projetos e tecnologias sustentáveis. Baseado no método hipotético- dedutivo, o estudo apresenta os créditos de carbono como alternativa para que seja possível alcançar as metas de redução de emissão dos gases de efeito estufa, sendo que o objeto de estudo específico são os Mecanismos de Desenvolvimento Limpo que podem ser utilizados pelos países em desenvolvimento. O presente trabalho tem como objetivo demonstrar que no Brasil, ainda há indefinição quanto às normas regulatórias que estabeleçam a natureza jurídica desses créditos, o que acaba impossibilitando o adequado tratamento jurídico sob esse tipo de comércio.
